The Community Organizer delivered his "jobs speech" yesterday, and it was typical Obama.  A complete joke.  This is a man who hates the private sector.  He referred to the private sector in one of his books as "the enemy."  When you have a man in love with government - when you have a man who believes America's greatness comes from government - and when this man decides to give a speech about jobs you can rest assured the speech is going to be about all of the wonderful things that government can do to save the day ... not what government can do to enable the jobs creation machinery of the private sector.

 

Barack Obama has the lowest first-year approval rating ever recorded for any president at this point in their presidency.  There's a reason for that. 

 

Let's take the first point in PrezBO's enlightened speech: 

 

Well .. let's see.  Obama wants a zero capital gains tax rate for small businesses for one year.  Wow!  Isn't that amazing!  Let's look at the definition of a capital gains tax:

 

"A capital gains tax (abbreviated: CGT) is a tax charged on capital gains, the profit realized on the sale of a non-inventory asset that was purchased at a lower price. The most common capital gains are realized from the sale of stocks, bonds, precious metals and property."

 

Do you see the big glaring problem here?   The problem with small businesses is not what they pay in capital gains taxes, its what they pay in INCOME taxes.  By this time, if you've been listening to my show or reading this blog, you should know that most small businesses in this country - the businesses that provide most of the jobs and nearly all of the new job creation.  The owners of these businesses are not sitting back worrying themselves to death over paying a tax on the profit from the sale of a non-inventory asset that they purchased for a lower price.  They're worried about the taxes they pay on their profit!  And they're worried that those taxes are going to increase!  Why?  Because these small business owners are the exact people Obama talks about when he talks about tax increases on the rich.  These are the very same people that Pelosi is talking about when she rants about a surtax on the rich to pay for health care.  These are the people who are going to get nailed when the Democrats celebrate the expiration of the Bush tax cuts.  These are the people that some Senate Democrats want to hit with a "war tax" to pay for Afghanistan.  The Community Organizer wants you to think that the issue is capital gains taxes? 

 

If Obama wants to get these people to start growing and hiring he needs to tell them that their taxes are not going to increase .. not on his watch.  These small business owners feel like they've been laid on a plank with their head in a notch ... ready for the blade on the guillotine to fall.  He needs to tell these people to stand up.  The blade isn't going to fall, and their taxes aren't going to increase.  Yeah .... Fat chance, right?

 

Then Obama tells us that he wants the government to start throwing money around for people to caulk windows and weatherize their homes.  This is how Obama thinks we can get the American economy going again?  Whoever named this part of the Obama jobs program "Cash for Caulkers" is brilliant.  What our brilliant leader is doing here is using his environmental radicalism as an excuse for more government spending - all in the guise of creating jobs.  What do you think the chances are that 40 years from now some family will be gathering at a holiday dinner to hear grandpa tell everyone how he built a fantastic career using government money to install insulation and caulk windows.

 

OK ... so there's more.  Obama wants to cut the employment tax for one year.  Employment tax?  What's that?  It's the income taxes, you socialist!  That's what these businesses are fighting!  Income taxes!  You threaten to raise their income taxes by as much as 10 percentage points, then promise to cut their "employment tax" for one year .. and you think these people are going to rush out there and start hiring people?

 

Obama thinks the way out of this mess is for the government to spend more money. How about more spending on roads and bridges?  Let's look for $50 billion in "shovel ready" construction projects --- government construction projects!  Government, government, government.  It's all about government.

 

Let the businesses keep and spend more of the money THEY earn!  Private sector employment built this country.  It was the private sector, not government, that brought us our amazing standard of living, one admired and coveted the world over.  Turn the private machine loose!  Cut the restraints!   I know ... I know.  That's just not you.  You believe so wholeheartedly in government that you just can't shake the addicition.

    CGT started out at 28% and has been working it's way down to 15% I think it's at now, but regular income tax remains high and is threatened to go higher. Maybe lowering the CGT will help some, but it's still about high income tax and uncertainty about what to expect that is hurting. So no, unlike some who think everything is about Obama, it's about it not being the grand solution he wants you to think it is. I mean who has any stock left to sell to take advantage !!!

    Thanks Neal. You nailed it. My wife and I run a small Sub S consulting shop. We love the work but are getting killed by the taxation and uncertainty in the economy. When I heard Obama's cure was to decrease Cap Gains, I first thought he was just being disingenuous. The more I think about it, the more I'm worried that he may truly have no idea what levers will most effectively grow small business jobs.

    Why does Neal think Obama's proposed capital gains elimination would have no effect on small business job creation whn it was a proposal in the Contract With America? According to this Cato Institute policy study from 1995, a capital gains cut or elimination is great for small business job creation. Is the real objection here because it came from Obama?

    You know, with all the people here claiming to be small business owners I can't believe this hasn't come up.

    I have a a couple of quibbles.

    1. "Capital gains" tax is not simply the tax one pays on the sale of equipment. Skeptic, I hate to say that your assumption your sister pays little to no capital gains tax on her business because she's light on equipment is wrong. She probably pays little to no capital gains on her business because her business is anything other than a corporation. The whole idea behind corporations is that they're "artificial persons" who sell not only whatever it is they make or do but also sell shares of themselves (stock). Stock is an intangible and its sale (or dividend) is **absolutely** taxable under capital gains. That's the whole deal behind the Dems' capital gains move.

    Now: Let's ride the logic train. Since most corporations are small enough not to trade on the public market, Obama's stocking stuffer won't mean much, if anything, to them. But for publicly-held businesses, it's a big deal. Believe me, they pay plenty for selling their shares.

    2. On another note: about employment taxes. Everyone who works is familiar with the 30% jacking we get every time payday rolls around. Deductions like federal (income tax, btw) withholding, FICA, Social (In)Security and state and local withholding take a chunk out of our paychecks. Those are the taxes we, as employees, have "withheld" from our paychecks every payday, which employers are bound to turn in to the IRS et cie. on their due date (which is monthly or quarterly). That's also what goes into our "tax account" at the end of the IRS' fiscal year and is counted as what we've paid in to the system so far for the privilege (!!) of working.

    What isn't mentioned in Neal's piece is that employers pay their own taxes on employees too. They have to match (!!) what we, as employees, pay in to FICA, SS and Medicare. (Yes, match. That means "over and above what we turn in as employees.") On top of that, they also owe the feds and the state **unemployment taxes,** which function, more or less and extraordinarily simplified, as "premiums" for us workers if we ever get laid off or the place burns down or whatever. Those are owed on both the state and federal level.

    Now IF (and it's a **big** "if") Obama intends to truly keep employment taxes at their present level instead of raising them, that's a good deal for business. It's not going to increase their costs to hire people at least at face value. But government has a disturbing tendency to give with one hand while robbing your pockets with the other. It remains to be seen what the next "tax on the 'rich'" is going to be.

    I know! I should not be shock but sometimes I can not believe what comes out of people's brain. I can't believe he actually thought we needed this debacle of health bill because of people like him. You know what art is subjective and not everyone would agree on the beauty it brings to the world. This explains why well paid actors are peeved that people in the financial industry are also well paid. I guess they believe they have a right to their money because they beautify the world while business people do what is necessary; I have no problem with people (including those actors such as Will Farrell) making lots of money as long they legally earned it (Management and gov’t nonsensical regulations were responsible for the failure on wall street-demonizing all business individual is illogical).

    I mean the nerve of some people! This is what happen when some refuse to teach our kids self respect, personal responsibility and shame--I say bring back shame; it works when used appropriately!

    remember when the presidents poll numbers fell so low that many were calling for him to step down and resign to make way for the new administration?I'll give you good odds that you won't hear those same people calling for Obama to do that even if his numbers reach zero.But then we all know it was all bush's fault,hi unemployment...bush's fault,hurricane katrina...bush's fault,damn car won't start...bush's fault,heartbreak of cirriousis...bush's fault,embarassing rectal itch...bush's fault.well a least bush took the blame like a man and didn't whine and blame others like crybabyobama,according to him he has not ever made one mistake,a perfect sinless life.there was only one sinless man in the world and he got nailed to a cross for it..I doubt obama's fate will be the same but if obama could pull it off I'm sure he would die,be buried for 3 days and be resurrected just for the P.R. image.

    And, by the way, my sister is an Obama voter. COntrary to the narrative here, a person can be both pro-business (and even a business owner) and pro-Obama. Truth be told, she might be slightly better off financially under a truly conservative administration, but some people vote on matters other than what the third digit to the left of the decimal point in their bank account balance will be.

    Nothing is wrong with voting on issues not related to the economy if it does not extremely harm the economy of the country. Without a robust economy, a country is a third world country, a developing country or a country that is heavily in debt.

    It is like the Artist/Musician who called Neal who complaint he has not been to the doctor in years for lack of health insurance. First of all I am sorry about his plight but he chose that plight it was not forced upon him, therefore he can not force another to take care of his medical needs. Those needs were his responsibility and cannot fault the rest of us for his lack of medical insurance. Artist do not earn that much, it is not news; what happen to learning thru others mistake. Did he think he was going to be the one to break the mole? Fine that he taught so but after a certain amount of years without financial success, he had a duty to himself to change discipline or to find something else that utilized his talent but was financially viable. He has no right to distribute his failure to us. We are not nationally responsible for individual bad choices and should not share in their lost. If he needs help, he needs to look to his family and charitable institutions which is aplenty in this nation—I know because I love to give to those institutions. Finally if he believe Canadian heath care is better than why not move there; people do it everyday when they are discontent with their birth country or adopted country. My father stayed in this country because he liked the freedom it offered and did not like the lack of freedom in the country where he and I were born. I am with Neal (minus the curse words) on his response to this Artist/Musician. It was harsh but somebody got to do it; another problem is some of us do not want to hold people responsible for their actions, lack of planning, and lack of sense.

    I am sick and tire of people making choices with foreseen results (e.g. artist, actors, teen pregnancies, unprotected sex, unwed mothers etc…) asking us to take care of them because it is a right—No your survival is not a right to be provided by all, it is a right to be provided by you, the individual. No one beside me and my minor children, and retired unable parents have a right to my labor. I don't mind paying reasonable taxes to the federal and state gov't for common beneficial things (e.g. roads, public school (primarily for unfortunate children with irresponsible parents or parents who are responsible but cannot afford private school), nonpolitical medical and energy researches, etc...); I have problem with paying taxes to take care of irresponsible adults (e.g. welfare).

It just that I am fed up with the illogical and unreasonable verbiage I am getting from our gov’t, liberals, the lack of care by some conservatives, and poor response I am receiving from the GOP to counteract this debacle of a heath care with so many ammunition at their disposal. I was having a conversation with a friend who told me, they are not worried because life on earth is just a passing phase; they have a greater faith that would sustain them. As a Christian I believe we all have a purpose on this earth and if we didn’t what is the point of being here—I believe God is reasonable and logical; he would not do this exercise (Life) just because he can. What happen to God only helps those that help themselves.
  • Critical Analysis is dying
    The problem is that most liberals are not critically analyzing the information (e.g health care, job summit, capital gains exemptions etc…) we are receiving the gov't. If they did this, they will not be for most of these gov't spending or these health care bills. Critical analysis requires two things, critical reading and critical writing. Unfortunately the health care bills are so convoluted and polarizing that many will not bother to read it or discuss it. The Democrats today are submitting information to evoke emotion instead of providing information with factual evidence sans emotions and logical reasoning. The information they are presenting are not clear on facts, they are not accurate, and are not coherent.

    Many who work for another heard the president on small business and capital gains will probably say see he is cutting taxes on small business without a critical analysis of his offering because it sounds good. Neal is absolutely right on the capital gain issue. Yes, some small business pay capital gains but those are in the small minority; the majority of small businesses does not pay capital gains-most reinvest in their business and rarely sell their business property, if they do, it is usually at a loss.

    I am so peeved by this health care bill that sometimes I don't know how to express it. The GOP is doing such a bad job countering the Democrats' health bill. All they need to do is apply critical analysis to it on a national forum that mostly caters to supporters of this bill such as MSNBC, ABC, CBS, etc.. If those channels will not give them air time then make an information or commercial. Explain why this bill is bad for America. Explain to them how it will affect them personally (liberal or democrats are free with other peoples money but not their own) such as if the bill is pass, it can cause them to loss their jobs, they may go to jail if they don’t have insurance, they employer who buys their insurance will most likely terminate their insurance, they may be responsible for their own insurance without a possible pay increase etc…

    According to figures I've seen, these "jobs" that NObama and Co. have supposedly created or "saved" have cost us an average of $276,000 EACH! I don't know about the rest of you, but give me $20k of that and I'll spend the s**t out of it! THAT is what will create jobs! REAL tax cuts for businesses will help once spending by consumers starts to pick up but until then, you're pissing in the wind with them.

    Until consumers start spending again, there won't be any need for new workers!

    You totally missed my point about the CGT, your sister probably would NEVER pay them cause small businesses very rarely sell non-inventory items!!!! Unless they are going out of business, or changing out equipment for new equipment which oops wouldn't work either cause that's covered under depreciation. Hmmmmm, nope don't think this is going to help anyone hire more people.

    I doubt sister paid any capital gains taxes because as a consultant (in the field of petroleum supply and trading), she has a very low capital-intensive business . .. basically a computer, a printer, and a desk in a guest bedroom. So, no, capital gains taxes on business would have little relevance to her work.

    And, by the way, my sister is an Obama voter. COntrary to the narrative here, a person can be both pro-business (and even a business owner) and pro-Obama. Truth be told, she might be slightly better off financially under a truly conservative administration, but some people vote on matters other than what the third digit to the left of the decimal point in their bank account balance will be.

    I do work with county roads, but that is just a fraction. Majority of my work is (was) private interest oriented. Much of the same equipment works for rain water harvesting, septic systems, run-off mitigation, etc. When the private entities dried up there was no government work to keep the business going, so I had to lay off the people AND the government was creating a situation where I could no longer plan my finances.

    If businesses cannot plan/budget for taxes, utility costs, health care costs or even union interference, how can they say if they will be doing any hiring? Everyone is in a wait and see mode right now.

    All this CGT cut sound nice, but what it will take to get this economy going again is for PEOPLE TO SPEND MONEY! You can cut all the business taxes you want but until people start buying goods and services there will be NO NEED FOR MORE EMPLOYEES! GIVE THE MONEY TO PEOPLE TO SPEND. THAT WILL BRING JOBS BACK!

    Alabamastan, you fail to take into account that THE GOVERNMENT DOESN'T PRODUCE ANYTHING. The money it uses on an infrastructure project must be taken from someone else. That money is not available for a private-sector job. Bottom line: the government cannot, on net, create any new jobs. it just moves money around.

    Joyce: you want to know why the infrastructure is not maintained? It's because there's no glory in it.

Well despite for the 8 years in charge we did nothing to help small businesses and only bent over to big businesses, I say we start a Tea Party protesting ALL Businesses. I say liberals like Warren Buffett, T. Boone Pickens, and Bill Gates are nothing but Lucky guys and really dont know how to run a business. Lets protest them.     It is ok to be a skeptic. That is part of the fun posting here. Generally, the fakes can get filtered out. So your wife runs a business? What type of model? What market segment? Does she manage everything soup to nuts, does she use an accountant, or does she split the difference? How does she deal with state sales tax and unemployment premiums? What sort of benefits does she offer and what sort of broker does she use? Have the unemployment premiums gone up for you, by how much, and when did you find out? Equipment involved? Office space? Do people use their homes and what sort of tax implications? Do you run as an S-Corp, LLP, LLC, etc (has implications regarding how you file and how much paid to the state to stay registered that way)?

    These should be easy questions to answer. If you try pulling the wool over our eyes it will come out.

    So your sister's business (which may be prostitution for all we know - you yourself said anonymity means nothing can be verified) is doing well. Your logic is that since her magical business is doing well, then all businesses are doing well. The 10-17% unemployment rate is fiction because your sister said so. And that should enough for the rest of us too.

    You sir, are an idiot. The employer who pays your "handsome salary" must be so proud of your intellect.

    So what your saying is that since your sister's business is doing fine, everyone's business is doing fine, right? You know, that "it isn't happening in my own little corner of the world so it mustn't be happening anywhere" attitude. Here's a little clue for you: What's happening in your own little corner of the world isn't the same as Boise or Memphis or Sanford, NC or Berlin, OH or Podunct, TX or wherever. If I were a contractor based on the statistics of new home construction right now, wouldn't it be feasible that business would be a little slow at the moment? Or what if I were a travel agent. Not too many vacations at the moment is there. Or if I were a house painter or landscaper or one of a thousand business that are struggling right now. I'm not saying your wrong about people coming on here and claiming to be small business owners who may not be, I'm saying that everyone's lives aren't going according to your life. Learn to live outside of your bubble. Remember, just because you live in Florida, this doesn't mean it can't snow in Sioux Falls, ND.
  • Hey SKEPTIC, Small business owner here.
    I didn't complain that my business was down, but I did claim to be a small business owner. My wife and I are both licensed professionals with a small office. We have two full time staffers and two part time staffers. Even though we are lawyers, the payroll is so complicated to manage (due to tax withholding, SSN accounts, unemployment insurance, Medicare, W-2's, etc.) that we pay an outside payroll company to handle it for us. It would be much simpler if we could just write a check to our employees every Friday.

    So, Skeptic, if small businesses employ 80% of the workers in the US, why is it so hard to believe that so many commenters here are also small businessmen? After all, it's the guys on the ground like us, those who see the real damage of Obama, who are most likely to be drawn to a website like Nealz Nuze.

    Of course, I'm also an architect ("seen the new addition to the Guggenheim?") and a marine biologist. "The sea was angry that day, my friends."

    Excuse me for being skeptical, but there are a suspiciously high number of posters here claiming to be small business owners. Maybe you are, maybe you are not . . .the beauty of the anonymity here is anyone can make any claim they want to regarding credentials. Another example is we seem to get a lot of people claiming to have science or engineering Ph.D's whenever climate debates come up.

    And what is funny is almost all the "small business owners" who post here claim to be suffering greatly and laying people off. I guess you're not very good small business operators (maybe you need to spend more time running your business and less time listening to talk radio). I for one am NOT a small business owner (I work for a company for a handsome salary), but my sister is, and her business is doing just fine.

    And, doing some kind of cheesy "make money at home" scheme advertised on daytime or late night TV does not make you a bona fide "business owner".

    I'd like to see Nealz Nuze institute a screen name registration system like most other comment sites do. One screen name per email address.     Neal, give President Obama a break. Before he became President, he never managed anything bigger than his Senate staff. All of the payroll, taxes, I-9's, W-2's, etc., were done for him by some Congressional office. Obama has no idea about what the difference between income taxes and capital gains taxes means to a small business owner like me. Barack has never managed so much as a local Dairy Queen, although he wrote two autobiographies as if he had invented television and cured polio. (Stole that line from some Brit columnist.)

    Anyway, Obama is such a nice guy. His weaknesses are simply ignorance and a complete lack of humility. He really cares about people, and he really believes -- all empirical evidence aside -- that socialism can work if some bright guy from Harvard is running things.     I think doing your own home improvement repairs actually counts as a job lost since you didn't hire someone to perform the task but the feds will count it as +2 jobs for each task completed.

    I do work with county roads, but that is just a fraction. Majority of my work is (was) private interest oriented. Much of the same equipment works for rain water harvesting, septic systems, run-off mitigation, etc. When the private entities dried up there was no government work to keep the business going, so I had to lay off the people AND the government was creating a situation where I could no longer plan my finances.

    Let's see - - where does the steel to build the construction project come from? The conrete? The design? They would be contracted to businesses in the private sector. Those businesses would need workers, who would be paid. They would take that pay and spend it, stimulating the economy.

    This is the same argument Neal makes in defending luxury items against taxes. When a person buys a jet, he puts people to work, the get paid, etc., etc.

    Yes, the difference is that the government is providing the project, but when is the last time you heard of a private entity build a bridge or repave a highway?

    So off my rant about my construction business being on hold and on to some good business news.

    Recently, I have been getting more people coming to me for instruction on tactical handgun training. I am not talking about people that want to hit a target 15 yards away from behind a counter. I am talking about people that want to learn how to shoot on the move, shoot under stress situations, shoot while injured, heavy duty stuff. About half of them are from California that recently arrived in Texas. Funny, my hobby/other work stuff is now starting to bring in good money while construction is off.

    As much as things are bad here in Texas, the stories I am hearing from my customers coming from California about people not getting medical attention, long lines of unemployed, all sorts of things that the media is not reporting. There are some really bad places out there folks and there are some really scared/angry people. So who really thinks that the great messiah, Barack Obama, has really made life better????

    Does this administration understand anything about the tax code or business? How is this going to help me? I won't hire anyone until there is stability. I am starting to feel like this environment is becoming like a third world country- you never know what sort of decree is going to come from the dear leader or his cronies. You can bet that I will never hire a democrat/socialist voter if I can help it. NEVER will I hire someone that votes for criminals that ignore the constitution, crap on states' rights, raise my taxes to give to non-producing looters, unions and hacks and want to get into every aspect of my life.

    When this fiasco started in January, I started laying off people from my business and shutting down. My concern? Where were the taxes going to go? Where was the unemployment insurance going to go? Where was the government going to screw me on medical?

    Starting 2010, the unemployment insurance rates go to a sliding scale. The bottom of the scale is over double what I was paying to up to 20 times! If I had employees today, there would be no way that I could plan ANYTHING except plan to get screwed.

    Obama is killing businesses AND he is running this circus in Washington with all of his clowns popping out of those little electric cars. Dam that fascist pig bass turd! He is nothing more than a sack of Pelosi.

    Remember how when Warren Buffet was campaigning for BO he used to always rail about how he didn't pay enough in taxes, and that his secretary paid a higher tax rate than him? This was because he doesn't receive a salary (so he doesn't pay income taxes), and lives off of his Capital Gains. So his tax rate was 15% for stocks held longer than 1 year. Well I guess he is going to be really mad at BO now that his tax rate is going to 0%. Now his secretary will be paying a 25% income tax and he will be paying no taxes (since he compares his Capital Gains to his secretary income taxes). BO and Buffet are morons. I am all for lowering Capital Gains taxes to 0%, but it isn't going to help out the small businesses like Neal said!!!!!

    I am a Nuclear Engineer and when I think of how many reactors that could have been built with that amount of money; the amount of good, well-paying *permanent* jobs that would have been created; and above all the amount of clean safe reliable energy that would have been made available, I am absolutely sickened.
