    Yes they were in a war zone, soldiers of today don't fit the regular definition of being in uniform, that entire area could go to war and not one uniform be seen, but they are still soldiers.

    And here we go again with snarky & Co. saying "why didn't they do it ...." and again I remind them, two wrongs don't make a right. Yeah they should have already had the military tribunal. But they didn't. So let's have it now. Over 65% of Americans do NOT want them tried in New York, why do you hate Americans snarky?

    And if they get off, yes I can see them maybe not going to Starbucks but every talk show host in America tripping over each other to get the first interview. Yeah, another platform for their hatred.

    the problem is, just like people who want to treat KSM like some "special" kind of killer, terrorism is about creating fear - I say we don't cave to that and treat this like what it is - islamic hillbillies with an axe to grind.

    Do you really believe that federal prosecutors and the AG just "overlooked" the notion that KSM wasn't read his rights? I mean, disagree with their decisions, fine. But, if you think a bush league argument like that is the "big hole" in their case you're friggin retarded.

    This is just my take:

    DOJ had a choice here. They could have moved forward with a military tribunal or a federal case.

    To think that, in a tribunal, the defendants still dont have a defense (like a fed case) or arent' able to mount a defense (like a fed case) I think is incorrect. The only difference is the jury pool, the judge, and how the case is brought against those charged.

    And the idea that KSM would be aquitted in a fed case is A)ridiculous but B)do you think that, by some stretch this did happen, that he'd walk out of court and down to the local starbucks? No. Never happen.

    So, to me, this is about how justice is applied. By or treating these guys like soldiers in a war or common criminals.

    if I'm the AG, I treat them like criminals because, to treat them like soldiers is wrong and completely caving to their wishes - that is, to be "at war" with the US.

    Look, I"m biased to be sure - Terrorism to me, is this scraggly remnant of villagers who have no clue how the real world works and have, unfortunately, many means at their disposal to disrupt it.

    If you look over the course of history, death from war as a whole, even if you include current wars and terrorism, is WAY WAY down. Our world is becoming more and more peaceful, not violent.

    But, these freaks remain.

    Better to treat them like the remnant wack jobs they are then as some kind of legitimate military force.

    They aren't. not even by a long shot.

    I dont want to make that sound like I'm not aware of the risks they pose. They can and are very dangerous and, as I said, in today's world, they have many means to greatly disrupt the global economy and murder thousands.

    But I still hold the view that terrorism is just what's left here, not the "next big threat". And, given that view, and given the miniscule risk of trying KSM in a fed court, and given the benefits of treating him like a common criminal - this makes sense. To me.

    better to sluff them off like the fleas they are then treat them like some established military force. We have proven that people like this can be tried, convicted, and imprisoned in our country with little problem.

    Why make KSM "special"? To me, that's the approach most akin to what al qaeda would like to see.

    I looked and from what I can find, KSM was taken in Rawalpindi, Pakistan, March 2003. Was not the US conducting a "war" in Afghanistan at that time? Would that not be considered a part of the theater of operations for that conflict involving the Taliban? In essence, this guy was captured in a war zone?

    Not trying to start a flame war. I am attempting to see if we can agree on some facts and determine from there the basis for a tribunal. I did not see the entire interview with AG Holder, but might he have said that KSM was not taken in conjunction with a military operation or in a war zone???

    I am almost willing to walk down this path with you but for one problem.

    Congress authorized the President to walk like a duck, smell like a duck, quack like a duck, and sh$t like a duck. So, he must be a duck.

    As I have watched this discussion played out with alleged scholars of the Constitution, if Congress authorizes the President to conduct hostilities tantamount to conducting a war then it must be a war.

    Flame me if you like. I know that I did not do the argument justice. I am not an attorney, just a lowly retired Army type that woke up in a MEDEVAC tent one day with my head pounding, my ears ringing, blood emanating from all of my orifices, broken bones, wondering WTF???!?

    I do not recognize this government anymore anyway. All I know is that a lot of men and women are dying from a lot of violence from a group of Muslims that definitely declared war on us.

    I continue to be astounded by the sheer bulk of the legislation Congress produces. Here's an idea for trimming the size and complexity of these bills: make congressmen and senators pass a comprehension test on a bill before they are allowed to vote on it. Make those scores public so we can tell who really does know what's going on. If congress thinks it's good for students to take a bunch of tests to prove they actually know something before they graduate, why shouldn't congress prove that they know something about the bills with which they are trying to saddle us. I guarantee laws would be reduced to a reasonable size or not introduced at all if every bill was an opportunity for our representatives to vividly display their ignorance and ineptitude by failing a test. Of course, they do plenty of that now, so it might not change anything.

    I wonder if Obama is really that stupid or if he is deliberately undermining the prosecution in these trials. This terrorist could get off scott free because Obama has compromised his defense. Why try them in civilian court anyway. It will cost a fortune in security for who knows how long. It would be much easier to try them in military court where there wouldn't be a civilian security problem. Just whose side is Obama on in the war on terror?

    Hussein (brilliant Harvard trained lawyer, and former President of the Harvard Law Review, ooooooo) is trying ksm the way he is to show the world we’re fair, then he publicly prejudges with certainty, not only ksm’s conviction, but his sentence and execution. Who’s going to believe ksm’s trial is fair now, unless he walks. Hussein’s real reasons for this insanity are obviously different from the ones he fed us, and like the timing, have ulterior motives. I think much of it is to legally turn 9/11 back to a civil crime, rather than an act of war.

    Hussein is also assuming we’ll be dumb and blindly bloodthirsty enough for vengeance to think executing one in the hand is worth the assets we will lose and the terrorists that will get away because of the secrets the USA will have to give away to convict him in a civilian criminal court, if they even can.

    I’m assuming from hussein’s certainty, that he’s at least smart enough to have already cut deals with his buddies at the ACLU, etc…not to keep this tied up in appeals for the next 20 years if ksm is convicted and sentenced to death. I don’t know though, I’m finding it difficult to underestimate his stupidity. Sometimes I wonder if the clintonistas aren’t advising towards making a fool of him to clear the deck for a hillary ’12 run (Kinda like Reagan running against incumbent Ford in ’76), I just can’t imagine hussein being this dumb all on his own.

    THAT is indeed a problem! One thing we have to do is get at least fiscal conservatives back in office REGARDLESS of the party. You are right that is a big problem. That's why I wish the GOP Michael Steele would step up and call out RINO's and ask them to leave the party. If they are no longer supporting the basics, they need to go. I would respect them a lot more.

    I'm not a Republican but I do realize that the Libertarian party is not strong enough yet to take over. YET!!! And there is that nasty electoral college thing we have to deal with on the presidential level. On state and local level if there is a Libertarian running, they get my vote. If not, they I look real close at the remaining.

    The Republican party can be made conservative again. If we could change the electoral college requirements, then heck yeah! Let em sink!!!!

    Page 182 of the senate bill has a provision for states to opt out of the "community health insurance" option.

    What I haven't found is a provision for residents of a state that would exercise their opt out option, to be exempt from paying taxes to fund the public healthcare plan.

    Does this suggest that your state could opt out of public insurance but the citizens of that state will still have to pay into it for those states that are in the program?

    You can give more of your yearly income to the government, to provide government managed healthcare to you and everybody else.

    Or, you can give more of your yearly income to the government, to provide government managed healthcare to everybody else!

    Either way, the government's real plan is to get a bigger slice of your American pie!

Notice he said nothing about wasted taxpayer dollars being returned to their rightful owners. What he means by his comment is that "wasted" money could be better spent on buying more votes. Also, be sure to check out the amount of money misspent by Health and Human Services. I can't wait to have these people dictate my health care.
