Our ethically-challenged Attorney General Eric Holder decided that it would be a great idea to bring 9/11 mastermind Khalid Sheik Mohammad to the United States to be tried. Well ... wait a minute. Let's get real here. It wasn't our pathetic Attorney General who made this decision .. it was the president; The Community Organizer. As the husband of a 9/11 victim said "Obama has transformed an act of war into a crime. And here comes KSL to New York City where he will get every protection our Constitution has to offer. Obama believes that the mastermind of 9/11 is nothing more than a criminal, rather than what he is really is: an Islamic goon, a terrorist, an enemy combatant, a prisoner of war. What we are seeing is the politics of the left trumping national security and common sense.

Just another reason to be so proud of those voters out there who fell for this "Change we can believe in" line. Here's your change: Acts of war become mere criminal acts.

Critics are concerned that this will quickly turn into a trial about Bush anti-terror policies, rather than the prosecution of a sick mastermind who killed 3,000 Americans. Rudy Giuliani says it best, "The government is going to try to put Khalid Sheik Mohammed on trial. Defense lawyers will try and put the government on trial." That is what we have to look forward to. Thank you, Oh Chosen One (mmm, mmm mmm) for providing these Islamic goons with the same liberties as the Americans they targeted. This trial will turn into nothing more than a dog-and-pony show for these Islamic killer. There is talk that KSM will act as his own legal representation. Why wouldn't he be? At this point, his goal is to be a martyr and he will chuckle inside knowing that Americans are willing to give him that platform.

Here's a possible scenario for you to consider: The politically correct crowd is going to come out in full force for the first part of the trial ... jury selection. The PC warriors are going to demand that there be Muslims on the jury. What if they succeed? What if the Muslim juror decides that there is no way he can vote to convict a warrior for Allah .. no matter what the evidence says. Oh sure, he can lie his turban off during jury selection and utter the right platitudes about reaching a fair verdict ... all the while knowing that he is going to do what any good Muslim would do .. protect a fellow Muslim from the wrath of the non-believers. Result? Hung jury. No conviction. And then where do we go?

Oh ... by the way. You do know that KSL was never read his Miranda Rights, don't you? How much evidence is going to be thrown out because this Islamic murderer didn't have his right to counsel when he was first captured?

Plenty of questions, aren't there? Try this one ... Then there's the pesky little question of ... is this even legal? Jamie Dupree points out the 2010 Defense Authorization Act, H.R. 2647 that Barack Obama recently signed into law.

Just so you know, the Republican did TRY to prevent this from happening. House Republicans introduced legislation that would have prevented Gitmo detainees from coming to the United States. But because Democrats have a majority, they didn't even allow the legislation to move out of committee.

    No argument here that Bush should have taken care of this. I was not asking - why should the PRESENT administration decide to anounce this now? The trial will not be untill 2012 at the earliest, so why not wait till after the holidays / first of the year? Make it the FIRST big anouncement of 2010...

    Yes, terrorists have been tried in the United States. However, these terrorists were captured on American soil, not in a foreign country. Because they were captured in America, the law provides for a trial in civil courts (as opposed to military tribunals). I defy you to find instances where illegal foreign combatants were brought to the U.S. for a trial in the civil court system.

    By the way, since they were not wearing uniforms they are considered illegal combatants, not prisoners of war. I would also note that, yes, 9/11 was an act of war, even though the Twin Towers were not a military target. Perhaps you have heard of Sherman's March to the Sea, the Blitz (bombing of London during WW II), Dresden, Hiroshima, or Nagasaki. These were civilian targets hit as an act of war.

    I have been an attorney for almost 26 years. I always tell my clients that anyone who tries to tell you they can guarantee what a judge or jury will do is either a fool or a liar.

    KSM was not tortured according to the Geneva Convention. They could have cut off his legs and it would still not be considered torture. There are no rules for prisoners caught out of uniform. They are considered spies/terrorists. The normal POW rules do not apply at all. They could lock him and all the other GITMOs away forever and no laws will be broken.
    As for the trial in NYC. It's a receipe for disaster but maybe justice (bullet to the head) will be served.

    The better question is why wasn't it done years ago under Bush? Why didn't he take care of business instead of just handing his mess over to the next administration? And guess what.... now instead of a cowboy from Texas, we have an apologetic, bowing liberal who thinks he can make polical hay by letting this low-life enjoy the benefits of the US courts -- something he certainly does not deserve.

    Eric Holder acts like he's out for justice. He's basically portraying this circus act as an 'eye for an eye' sort of thing (trial where the crime occurred), rather than admitting what this really is (a radical, anti-American, lame-brain president who despises the US military and who is attempting to weaken it).

    Good point. KSM is as guilty as OJ and doesn't deserve access to US courts. Eric Holder should lose his job. I used to think Bush blew it by not bringing bin Laden to justice but if the Obama Admin was just going to let Eric Holder try the guy in NY and make a complete spectacle of our law and of the people of NY, maybe the Bush Administration's incompetence isn't such a bad thing in this case.

    There will be a couple of liberals on the the jury who...no matter HOW conclusive the case against these terrorist might be....will refuse to vote for conviction, just to thumb their nose at George Bush.

    WHEN KSM is acquitted on a technicality -- because the defense can't find an impartial jury in NYC, because he didn't get Mirandized, because the defense can't access classified evidence, etc. -- we'll then have the Obama impeachment trials to look forward to instead.

  • This might be something to talk about...
    if all the prisoners from Gitmo or Bagram were going to be indicted and sent to a courtroom in the US. The fact that only a handful are going through that while some will be put through military commissions and others just locked away forever without explanation is a cruel joke. It's a case of which venue will the State have the best chance of a guilty verdict. For those like KSM, a regular court is good enough, but if the prosecution needs hearsay evidence to be introduced into court, it will need the military commissions. All the rest that can't be proven guilty based on our Western rule of law get to spend the rest of their lives in some dungeon. That is the real travesty in all this.

  • Just Wait Until KSM Is Acquitted, and Must Be Released!
    What troubles me about the whole decision to try KSM in a U.S. criminal court, and the media coverage of it so far, is that no one is pointing out the obvious end result - - once KSM is acquitted (and I think he will be, since there can be little or no evidence that could be admissible in court, whether due to the lack of a Miranda warning, or an inability or unwillingness to show the chain of custody for any physical evidence, etc.), it seems to me KSM will have to be released (i.e., having determined that KSM is only charged with a crime, that is subject to the jurisdiction of a U.S. criminal court, once acquitted of that crime there is no basis for holding him, and he will have to be released).

    The decision to try him in a U.S. criminal court, with all of the protections of the U.S. Constitution, is sheer lunacy.

    You got one thing wrong: KSM does not remotely deserve to be called a prisoner of war. That should be reserved for uniformed soldiers in a
    chain of commmand, following lawful orders, etc. KSM is a terrorist, and should be treated as such.
  • We are a nation under the rule of law
    You either believe in our constitution, the justice system laid out under it, and its ability to render justice, or you do not. If there is sufficient evidence to convict these men (which there most certainly is), they will not walk. The only thing that could possibly alter the outcome is if, say, multiple laws of this nation were violated to wring evidence from them.

    There should be nothing to fear in an open courtroom. Either we have a rule of law worth defending and to which we adhere, thus differentiating ourselves from terrorists, or our system is a sham and we need to resort to Third World justice to get the outcomes we want. If their guilt can’t be proven without resorting to allegations beaten out of them in a metal shipping container somewhere in Afghanistan, then obtaining guilty verdicts in kangaroo courts would reduce us to their level. Actually, it would make us inferior to them, as at least they are forthcoming about their disregard of the law.

    It will be interesting to watch. Many Americans have lost their sense of outrage over the 9/11 incident. Perhaps Eric Holder will inadvertently rekindle it. If KSM does get off somehow, New Yorkers will never forgive the Obama administration. And I would hate to be a muslim living anywhere in America.

    I'll give you all a hint: It used to be that we worried about CO2 – that will be replaced with worries about Alpha, Beta & Gamma.

    You guys need to make up your mind. Either KSM is a prisoner of war -- in which case, he is entitled to full Geneva rights and will be turned loose at some point; or he's a criminal and can be tried and imprisoned. What you guys want is to create some black hole in the law where we can do whatever the hell we want. That's not a system of government, it's pure thuggery.

    9/11 was not an act of war. An act of war is directed against military forces to achieve specific objectives. It was a war crime. We've had no problems convicting war criminals. The most you can argue is that he should be tried by military tribunal. But you can't really argue that he or anyone else can be spirited away into a legal black hole for all eternity.

    If Bush hadn't started this whole detention and torture business in the first place, we would be in a much better position. But he (and you) has so thoroughly caved into fear, you were willing to do anything, even destroy the rule of law, to placate your terror.

    Everything he has done so far speaks volumes: From trying to close Guantanomo, to forcing the release of classified anti-terrorist interrogation techniques, to his indecisivness to commit more troops to war, and now this.
