TERRORIST SUING GOVERNMENT LAWYER

Do you remember Jose Padilla, a/k/a Osama bin Lopez?  He was sentenced to 17 years in prison on terrorism conspiracy charges.  Well Padilla claims he was tortured while being held nearly four years as a suspected terrorist, and he is suing the lawyer who drafted the legal theories supposedly leading to his torture.  Padilla is suing former senior Justice Department official John Yoo who wrote memos on interrogation for Bush's Office of Legal Counsel.  He was apparently subjected to sleep deprivation, temperature extremes, painful stress positions, and extended periods of bright lights and total darkness.

 

The reason this is back in the news is because US District Judge Jeffrey White of San Francisco has refused to dismiss Padilla's lawsuit.  So this would be the first time a lawyer for the government would be held liable for abuse of detainees.

 

When can I sue the IRS for the torture they've visited on me over the years?

    but hardly a convicted terrorist either. We never nailed him with anything specific. Fact is, we abducted him with little evidence, held him for years with quasi-torture, and then wonder why he's mad. I dunno, Boortz, how about you go take a vacation to the Middle East, and end up in the wrong place at the wrong time, get arrested by the US military, and go through the same ordeal with virtually no evidence, and none of those liberties you usually whine about us losing? You, the Talkmaster, would be ranting such an insane storm of controversy that it'd be the number one story in the US! But when it's other people "accused" of terrorism, well, let's strip their rights and tell them they are lucky to be alive.

    what he calls torture sounds like the first few initial weeks of usmc boot camp.does this make every volunteer whom joins the military entitled to a lawsuit against our government? I too believe the IRS is using domestic terrorist torture tactics in an effort to defraud the public.when will we be able to sue them and their leaders as well..? look out turbo tax timmy judge whites gunning for you..LOL yeah right.

    Unlike the gov't that declared Haupt an enemy combatant, then convicted and executed him by military tribunal, Padilla never faced a tribunal. The government that initially declared Padilla an enemy combatant later recanted and allowed him to be tried in a US court. If you want to argue he should face a military tribunal -- ok -- your gripe is with the Bush administration. If you want to feel better about yourself by seeing this dirtbag fry, take it up with the people responsible for allowing him to face trial in a US court. Either they were wrong to declare that dirtbag an enemy combatant or they were wrong to later recant.

    As much as it would make you feel all warm and fuzzy inside, Cowboy, you can't just go around frying people accused of criminal activity without proving it.

    It was settled by Ex parte Quirin, 317 U.S. 1 (1942)

    Like Haupt, Padilla violated Article(s) of War 81 and 82.

    It's easy to sit back in a nice comfortable chair in your living room and justify Padilla's treatment by comparing him to the extremists who behead Americans or make his torture sound as innocent as having a spouse hog the bed (it's called a treadmill, andy, buy her one) or make excuses for Bush by alluding to some vague media conspiracy but none of this addresses the issue at hand: What did it get us? What did we gain by torturing this guy for 3.5 years for his suspected involvement in a plot to blow up a dirty bomb on US soil? We didn't even get enough evidence to charge him for it. Wow, torture must really work!

    Don't be surprised when this guy wins his appeal on the foreign terror charges and goes completely free. Guessing Bush won't be found standing under a "Mission accomplished" banner that day.

    Steve -- you do understand he wasn't a volunteer, correct?

    This sounds like a typical season on the reality show "Solitary" where folks VOLUNTEER to be put into solitary confinement for the duration of the show, and experience all those thing, and frankly, worse. Maybe Fox Reality Channel should hire the soon to be ex-Gitmo interrogators to help write for next season. People will still be lining up to get on the show and have their chance at winning the $50K.

I guess you live in the unreal utopia, How can you have any compasion for the muslim extremist who will kill anyone and everyone to do nothing more than empower themselves over humanity, This lowlife individual was planning to kill innocents plain and simple, now he is caught he is crying about his so called mistreatment, the way I see it he is still amoung the living, Would his victims have been the same? the beheadings and other acts these filthy creatures do to other humans makes me rather cold to their whining these days, I am sure Allah would not be proud of a segment of his childrens actions either.

    He was held in a medium security prison, true that he could only talk with his attorney, but no drugs or anything else was used.

    I don't think there's much question that Padilla -- a US citizen by the way -- was held for years without charges and subjected to things like sleep deprivation for weeks on end, which would meet any reasonable definition of torture.

    That said, I'm not sure suing the lawyer is justified. Justice should be brought to the men who ordered that sort of treatment.
  • It would be nice if a bunch of people started suing Jose and his lawyers.
    This is why enemy combatants, legal or illegal, US Citizen(as FDR held) or no, should be dealt with by military tribunal. They have no right to our criminal or civil courts. How many Americans will have their justice delayed and thus denied while this terrorist and his lawyers choke up our courts?

    This is great! It means we can sue everybody in the Obama administration for every bone-headed thing they put into writing. (There's a long list.) I'm gonna apply to law school, because there's gonna be a severe shortage when this new "sue the officials" industry gets rolling.
