RENTERS' RIGHTS

More government regulations are never the answer .. unless you are a politician who loves government and the power it provides them. In this case, let's go to San Francisco. The city's Board of Supervisors has come up with new regulations for landlords. These 'renters' rights laws' were written by Supervisor Chris Daly. One proposal would make it illegal for owners who want to move into their property to evict a family with children. With or without a lease. This would mean that once you've rented an apartment ... all you have to do is download a tricycle motor and you're in for good. The idiot politician who introduced this regulation moaned about "children having to leave the city where they were born." Cry me a river.

Among the most outrageous proposals from Daly is one that "bars landlords from increasing rent to more than one-third of a tenant's income. Realizing how asinine this idea is, he proposed an amendment that would limit eligibility to those who are unemployed, people whose wages have fallen more than 20% over the past year or those who solely rely on the government for a living.

By the way ... did you know that in San Francisco they have something called a "Tenant's Union?" Just wonderful.

I've owned rental property. It's a good deal. But here's a word of warning. If you're going to own rental property be sure that the property can command rents far and above what would be deemed "affordable" for some household living at or near the poverty level. In today's economy I wouldn't touch a piece of rental property that rented for less than about $2000 a month. Once you're above that level your tenant isn't going to be among that class pandered to by politicians. You might actually end up making some money on your investment.

What others are saying

  • What about Landlord's rights?
Hey, I have to maintain liability insurance to protect the folks renting from me. Aren't I entitled to rights?
  • Renter's Rights
As a renter, I have the right to live in the apartment I'm renting. If the rent increases to an amount I can't afford, then I have the right to MOVE! Sheesh!
  • Renters
Boortz: you have a serious moral reasoning deficiency. You overgeneralize that if someone cannot pay a $2000 rental fee, he is a scumbag. So...if you cannot own a multi-million dollar mansion while others can, are you a scumbag?? Your values are stupid, not far from Obama's irrational reasoning. Educated minds see through your fascade of superiority: you must feel really inferior to make such general judgmental statements about humanity. Materialism doesn't make someone superior. At death, we all go to the grave and reduce to dust, and we all go to one or the other destination - Heaven or Hell.
  • Renter's "Rights"
I smell Constitutional challenge here. This is a direct, uncompensated "taking" (See Amendment 5 excerpted below).

This is stealing property from rightful owners to transfer use\control (in effect, ownership) to another, further usurping the owner's property rights with no due process.

It is amazing how the Leftists and other Statists want to claim that the Federal Constitution applies to State and lower municipal actions in *some* cases, but not for *all*. If ONE Amendment, or other clause in the Constitution applies as a binding contract to all States and Citizens, then they ALL do.

This statute needs to be challenged, immediately. This is no different than that no Fed, State or Municipal government can force you to disarm save by force of (their) arms, or persuasion and\or threat. The only reason that the (firearms, etc) "control" laws exist is that we've collectively allowed this authority to be usurped.

Ok, enough ranting for now. Such suits are very expensive. A major reason that I do *not* own rental property is due to similar "renter's rights" laws here in CT.

    Amendment V (Excerpted)
**nor be deprived of life, liberty, or property, without due process of law; **nor shall private property be taken for public use, without just compensation.
  • Average rent
I googled it....the average rent in SF is $2300 per month. Nice place to visit but I wouldn't want to live there.
  • Unintended consequences?
Now we will have to put these people up somewhere on taxpayer money because renting out housing just became a real bad idea, and fewer will risk it.
  • 2-large per month
Would get you a studio apartment in Manhattan.
  • ?!?!?
less than $2000 a month? are you high?
why would someone fork out that much just to rent?
  • *FacePalm*
At some point, I am fearing that my income won't be able to keep up with the demands placed upon it by local, state, and fed government. Speaking as a renter: In reading Atlas Shrugged, I must echo the sentiments echoed by Dagney Taggart: "I don't want to be a looter!"
  • Wow
Really? that just, amazes me the audacity

Property rights have no meaning any longer.
  • Here's a good place for Atlas to start shrugging...
The logical conclusion to this will be that nobody will want to own rental property, and thus there will be nothing available for these people to rent. These units will either be sold to homeowners, or landlords will be forced to abandon rental property. Then there will be no evil rich man to make repairs, do maintenance, or pay property taxes.
  • Landlord rules
You do realize this will take a percentage of units off the market immedidiately. If the landlord can not make his expenses, he won't rent.
