DOESN'T LOOK TOO GOOD FOR THE OBAMA ADMINISTRATION

Despite Obama's warning that blocking the Chrysler deal would have "grave consequences" ... The Supreme Court granted the request to hold the sale of Chrysler to Italy's Fiat. Justice Ruth Bader Ginsburg said that order of the bankruptcy judge allowing the sale "are stayed pending further order of the undersigned or of the court." Fiat can walk away from the sale if it doesn't close by June 15th.

One of the issues here is the brilliant idea to stiff the secured interest of Chrysler bondholders in favor of Obama's union buddies.

Maybe we ought to let Chrysler decide what is best, rather than come to a hasty agreement in the middle of the night in order to comply with the Obama agenda.

    This is worse than if they had never looked at the case, because now it gives legitimacy to all the crap Obama is throwing at us. Feels like a set up.

    LIke I said earlier, nothing more than window dressing. This was a cute way of pretending that the administration didn't throw out the rules but in affect violated every corporate governance rule ever created.

    What does obama mean by "grave consequences? Why is he always threatening? I tell you he is executing a 20 year plan. He didn't just go into office and start from scratch. Pay attention America and World for that matter.

    What Ginsberg did is what is expected of a justice. She set aside her politcal beliefs and took on a case that should be handled at the SCOTUS level. Hopefully Sotomajor (sp) is taking notes.

    WOW! A justice who sees through the rhetoric, and illegality of the deal, regardless of party/idealogical lines. The UAW is the reason Chrysler and GM are in the mess they're in, so why on earth should they be rewarded for killing two great companies?

    I hop ethe UAW workers who lose jobs over this suffer serious financial loss, thanks to their over-reaching greed.

    Each Justice is assigned an area of responsibility, this one fell in Ginsburg's area, that is why it is her and not one of the others.

    Hal! Great catch, I wouldn't have seen that Fiat report till late tonight.

    Anne, that report is especially interesting since Penske is buying Saturn.... wonder is that same logic will be applied to GM dealer closings.

    Does anyone here know what advantage there would be to Chrysler or GM to close a dealer? Dealers pay for the vehicles whether they sell them or not right? They pay their own advertising. So what does Chrysler/GM gain? Serious question, not familiar with the workings of dealership.

    If this came from any other sitting member of the Supreme Court, I would take it more seriously. The fact it is Ginsburg is more the reason she is being led down the path by the Administration to make them be able to say, "see the checks and balance are working and Justice Ginsburg shows the commitment to honor all parties."

    This is nothing more than grandstanding and in a couple of weeks, FIAT will have their way at the expense of the US taxpayer.

    The statement "Fiat can walk away from the sale if it doesn't close by June 15" was an argument put forth by the Obama Administration's lawyers to keep the SC away from the deal. However, Fiat says that is a lie: http://www.cnbc.com/id/31182295
  • Fiat backing out?
    The media is portraying that Fiat will back out of the deal on the 15th. If it isn't a good deal for them they wouldn't be agreeing to it. So let the 15th happen, Fiat will wait if it is in their best interest.

    We'll have to wait and see if there are any checks. We assume the Supremes would not have taken a look at this if they weren't inclined to intervene. Let's hope so.

    Joyce, you're so right that to allow the Chrysler bankruptcy to continue would be a much larger problem than if Chrysler were to fail.

    If the Supreme Court finds ANY reason to let Obama get away with this the country is SCREWED!

    And let's not forget the scandal that's heating up about the dealership closings. Neal mentioned that he was looking for info on this this morning. The best information on Republican/ Democrat breakdown in closings can be found at zerohedge.blogspot.com (link below), who determined that "while the data preliminarily did not demonstrate a republican or democratic bias, there was some peculiar tendency in the data to favor Clinton donors." That leads us to this court filing from the owner of a closed Chrysler dealership in Little Rock. I personally think this sounds a lot more like Obama's style than just the straight anti-Republican angle:

    "On May 13, 2009, I received a letter from Chrysler notifying the Dealership that Chrysler had elected to “reject” our Dealer Agreement. I am obviously very familiar with the Little Rock, Arkansas dealer network and was surprised because both Cook and Crain, the only Chrysler dealers in Little Rock, were both rejected. Therefore, Chrysler’s action would, on its face, result in a complete lack of representation in a major American city. Since that would be a ludicrous result, one can only infer that Chrysler has a more sinister motive.

    Because it is inconceivable that Chrysler will not have a dealership in Little Rock going forward, the only conclusion that one could draw is that, after review, the evidence in other markets in the region, that Chrysler now intends to “give” the Little Rock market to a Landers-related dealer.

    Having reviewed the pattern of assumption and rejection of dealers throughout their region, I have detected a pattern: In every market where there is a dealership connected with former Penske Automotive executive Steve Landers, or his new automotive partnership with “Mac” McLarty (former Chief of Staff for President Clinton) and Robert L. Johnson (majority owner of the Charlotte Bobcats), the competitors are rejected.

    In the Little Rock, Landers Chrysler Dodge Jeep is located far out of town in Benton, Arkansas. Nevertheless, the two Little Rock dealers, Cook and Crain were rejected.

    In the Fayetteville, Arkansas area, Landers-McLarty Dodge Chrysler Jeep is located far out of town in Bentonville, Arkansas. Competitors Springdale Dodge Chrysler, Steve Smith County Jeep and Jones Brothers were all rejected.

    In the Shreveport, Louisiana market, Lee’s Summit Dodge Chrysler Jeep (a Landers McLarty dealership) is located in Bossier City, Louisiana. Both competitive dealers, Claude de Beaux in Vivian, Louisiana and Greater Birmingham Dodge Chrysler in Shreveport were rejected.

    In the Springfield, Missouri market, Tri-Lakes Motors (a Landers-McLarty dealership) is located in Branson, Missouri. Competitors Heritage Chrysler Jeep in Ozark, Missouri and Ramsay Motor Company in Harrison, Arkansas were rejected. A pattern seems to be emerging. Everywhere there is a Landers-McLarty dealership, Chrysler has rejected the competition.

    In the Huntsville, Alabama market, Landers McLarty Dodge Chrysler Jeep, is located in Huntsville. Competitor Cloverleaf Chrysler Dodge Jeep was rejected.

    Favoritism and cronyism towards preferred dealer group is not a valid exercise of business judgment."

    Jackie is right below. AIG which is in the Obama iron lung is finding it difficult to raise additional capital required by the "stress tests" because bond and potential share holders fear the long arm of the administration (and the consequences therein). When the rule of law isn't people vote with their feet or cash!

    Let's hope it goes the full review. Let Chrysler liquidate. The abuse of the constitution would cause more problems down the road than the collapse of one, albeit large, corporation.

    If these chrysler bond holders get robbed and thrown under the bus, why should future bond investors invest in American corporate bonds? This action (of not treating bond holders per the law) has future consequesences.

  • This is scary stuff
    This is really scary stuff here. I'm glad the supreme court has stepped in but I'm not sure how long they will last. I think Obama is setting them up brilliantly here. He's going to say they are using judicial activism by interfering with his orders from on high and he's going to use that to say that Sotomayor isn't any worse than the people that are on the court now. Once she's confirmed, he will have complete control.

    (I know this logic doesn't hold up to reason, but the country is ruled by democrats now, and reason doesn't apply to them.)

    Instead of the government deciding OR Chrysler..maybe we ought to follow the rule of law and remind both of these entities what "secured creditor" means.

    This would be like allowing a third party to award a foreclosed house to the lawn boy instead of the mortgage holder. It isn't socialism and it isn't fascism..it is theft.
