PREZBO GETS AN APPOINTMENT

Rumors have it that Justice David Souter is going to hang up his black robe. We knew this was going to happen ... and we know that the results are going to be a disaster. Now Obama gets to make his first Supreme Court appointment and the people of this country get to see the real consequences of their vote last November. It certainly isn't going to be pretty.

What to expect? Pretty easy, actually. Just imagine that someone goes out to Berkeley and asks a Marxist grad student to suggest someone for the Supreme Court. Good chance that the student would come up with pretty much the same name that Obama will present.

It's a cinch that Obama will not nominate someone who actually believes that the power of the federal government is or should be limited by the 10th Amendment to the Constitution. It's a certainty that Obama's nominee will not recognize and vote to restore our right to political free speech. But this is all minor compared to one very sinister belief that Obama's nominee will bring to the court .. and that is the belief that it is perfectly proper for the Supreme Court to consider foreign law and the rulings of foreign courts in their decisions as to the constitutionality of laws passed by and the actions of our own government. Our Constitution will no longer be the basis upon which rulings are made - at least for Obama's appointments.

This retirement will happen early enough in Obama's first term that he will be able to go leftist radical in his appointment. He knows that the American people have short memories when it comes to voting. He'll appoint a leftist radical and still have plenty of time to move to the center for the next campaign.

    Any one who thinks that the country/constitution is in more danger from the lefties on the court than from the righties needs to look at Ashcroft(Gonzales)v. Raich. That grotesque decision has put an end to states rights forever. The right wing's inability to live and let live has permanently eroded the very foundation of what was supposed to be a constitutional republic of quasi-independent states, so now the federal government is free to regulate anything anywhere in any way it sees fit. If/when the supreme court destroys the 2nd amendment you can bet it will be because of their success in destroying the 10th.

    So called "conservatives" are about to come fact to face with the brutal consequences of their power grab. You all thought it was OK to allow the government to run roughshod over our rights as long as it kept the reefer and the gays and science at arms length. Now someone else has that power, and he will probably use it against you, and you will undoubtedly cry foul. You will wail and moan and gesticulate madly about how "those damn dirty socialists ain't got the right", but guess what? They DO have the right, and YOU gave it to them.

    So, you will have to forgive me if I do not share your view that an Obama appointee will be more dangerous than another Roberts or Scalia.

    Conservatives rally around words like "freedom" and "liberty" and "individual", but at the end of the day, it's not about freedom its about forcing people to live the way YOU think they should, do only what YOU say is right, and there is no room for non-conformists. What's worse is that you wrap yourself in the American flag while you do this, and decry any and all dissent as unpatriotic.

    Individual liberty, and therefore ALL liberty, is going the way of the dodo bird, and it is not the fault of the left. The sooner all you right-wingers realize this, the better our chances will be of correcting the situation.

    Kurt, the Republicans did stick to their principles. Therein lies the problem.

    The past decade has made clear that what the GOP campaigns on are not their principles. When put into power they showed us what they really stood for: Big Government, bigger spending, open borders, increased illegal immigration, destruction of American industry...

    Both fiscal and social conservatives need to realize that neither party is their friend.

    The Democrats were left, the Republicans were right. They use to play checks and balances, which keep us near the center, bouncing a little to each side based on what Party was in.

    The Republicans under Bush went left and this allowed the Democrats to fire to the extreme left.

    The Republicans have defined "conservative" to only mean right-winged in social issues. Pro-life, traditional family values. That's it. Who cares if the spending is out of control and growing in power beyond any control....hey, pro-life...we're Republicans and conservative !!!!!

    Rest assured that 50% of the people who vote Republican have ZERO idea what being conservative even means.

    In reality, it's been the liberals justices, at least more than the conservatives, standing for our rights against excessive government power. The right wing of our court, which is unfortunately younger (except Scalia, the worst) believes that the government can do anything it wants to anyone regardless of any laws or any other impediment. They are the people who want the government to be able to kidnap and torture people without anything approaching a trial if they call them terrorists. They are the ones who think that the execution of innocent people isn't a big deal. They are the ones who think the First Amendment is a triviality in the face of the need to impose religious values and keep order. They think the police have infinite authority over us.

    It was liberal justices that helped end segregation, and other travesties. To the cries of "judicial activism".

    The Supreme Court conservatives have only helped the government erode our freedoms.

    Additionally, political donations are not free speech or expression in any sense. Trying to construe them as such is stupid.

    Obama won't nominate a leftist radical, and certainly no one that a "Marxist Berkeley graduate" would pick. Hopefully he'll nominate a liberal who will at least keep the court from falling completely to the extreme right wing. Since Souter was already okay, it probably won't make a huge difference. Here's hoping Obama gets to replace Scalia,

    Actually, I felt that it was important to point out that if the damned Republicans had actually stuck with their principles over the past eight years, we'd probably not be in this mess.

    The more we suffer the consequences of this last election, the more I think that maybe we need an actual conservative party.

  • I was all for the draft until I served in the all-volunteer military('84-'92).
    I never got within' 10k of a combat zone, but if I did, it was nice to know I wasn't depending on someone who was there against their will. I think much of the phenominal effectiveness and professionalism of our soldiers is due to the fact that they are all volunteers.

    The old hands when I was in said volunteers are easier to train, and can be trained(and crosstrained) further, and discipline was easier(they don't threaten troublemakers with being sent to the combat zone, they threaten them with being sent home). The kind of skill, cohesion, and discipline they have is especially important in counterinsurgency ops.

    It's a different mentality from from an army of levees, and there's no question which I would prefer covering my flank or rear in a dangerous place, or my country while I sleep warm and cozy at home. You're going to have a few bad apples in any barrel that big, but for the most part, they are all the Pro's from Dover now, and the results speak for themselves.

    That's my view on it, but I can respect and understand the merits of your view damifiknow, they seem to mirror my Dad's.

    Souter hasn't been voting with the conservative or in the middle since the Clinton years. He's more likely to vote with Stevens than Scalia. I fail to see the issue here.

    I told most of my undecided or un-political friends ever since I became "politicaly aware" way back in the Nixon days that I you have no other reason to vote than the appointment of supreme court judges is reason enough.Most of america has no idea of the influence a president has on the country thru these appointments.We are still feeling the affects of appointees from 150 years ago,their rulings never go away.Thanks to the"gubernmnt skools" citizens have no friggin idea how the supreme court works, what it does and how it affects us.(just to throw this out there...I'm in favor of bringing back the draft because it FORCES citizens to pay attention to politics,if only for the selfish reasons that now they have a pPERSONAL stake in what government does.It don't get more personal than 18 mos. of active duty in a hot zone.)any comments are welcome.

    The GOP rarely stood their ground on these absurd appointments before, even when in the majority, making stupid and empty threats of 'going nuclear.' Now they will get a lesson in how to wield power, and there is nothing they can do about it.

    These judicial appointments are what will do the most and longest lasting damage, after all, Federal Law and the Constitution itself means whatever they say it means.

    Souter was with the Kelo majority and had moved to a reliable liberal vote. It's highly likely this will have little change on the court's decisions.

    Don't forget that Obama will also get to fill Ginsberg's seat soon due to her cancer, so he'll have 2 seats on the Supreme Court that will well outlast his presidency. That's scary.

    I saw in a news article that people were commenting that this would become a circus- that's just wrong. Obama has a majority and the Republicans aren't organized, nor interested in fighting. He'll get anyone he wants, so long as there aren't any pictures of them buying drugs on a street corner (and that might still not stop them). Pube on a can, that's just fun and games, right?! Right now it is. The articles also noted that Hillary Clinton is a possible candidate- how great would that be? A life long option to mess up the country. I'd bet anyone with a stong interest in constitutional law will never get a nod, nor anyone with a US historian background. It'll be someone from a noted college department.
  • Souter's Rulings
    Justice Souter has been a disappointment with his leftest rulings; including his decision regarding a government's right to seize private property so a government can increase it's tax base.

    Souter has been wrong on most decisions because he has had the mistaken notion the Constitution and Bill of Rights are living documents. Read the Bill of Rights CLOSELY and one will see the only Amendment that specifically is a living right is the 8th Amendment when it defines cruel and unusual punishment. He has not understood the Constitution is a contract with the citizens, and contracts do not change because they are living documents. Using Souter's rational of the Constitution being a living document validates other living changes such as the legality to leave the Union when it no longer is for the common good. If one non-specfic right is living then ALL are living and the left of center can not pick and choose which they wish to interpret.

    In all probability TOTUS will choose a far left liberal for the slot that will also believe as Souter that the Constitution is a constitution and not a contract with the citizens to protect citizens from its government.

    You know what would be even better than waiting for Obama to name his nominee then asking socialist professors if they agree?

    Ask them first!

    Find some real left wing loon college professors, known socialists, Marxists, etc.. and ask them "Who would you like to see nominated to the Supreme Court?"

    "What are same people that, if voted to the Supreme Court, would make decisions that align with your socialist views?"

    Then, when PrezBo makes the decision we can go back and see if, without prior knowledge, he makes the same call as a known socialist / Marxist.

    I'm sure it wouldn't have any major impact right now, but it sure would be interesting to see the choices line up.

    Berkeley is one of the best schools out there. Their grad programs are also in the top of their respective fields. Sorry Neal that most of your listeners went to Christian schools with curfews and no socializing w/ the opposite sex.
