The media is going to be buzzing for a long while over who Barack Obama is going to nominate to replace Justice Souter on the Supreme Court. Initial reports suggest that Obama's top choice is 2nd Circuit appeals Sonia Sotomayor. Only Sotomayer is already catching a lot of flak for this comment:

"All of the legal defense funds out there--they're looking for people with court of appeals experience. Because court of appeals is where policy is made. And I know, I know this is on tape and I should never say that because we don't make law. [Laughs] I know. I know. [Laughter] I'm not promoting it, I'm not advocating it, I'm...y'know."

So .. there you go. The perfect liberal. This woman - who may become a Supreme Court Justice - thinks that courts make policy. Probably just the type of person Obama would love to have on the bench.

What others are saying

  • From Sotomayor's acceptance speech, 5/26/2009
"I strive to never forget the real world consequences of my decisions on individuals, businesses and government."
Interpretation of the law is to be applied by means of an emotional filter regulated by the personal experiences of SC justices?
  • Law = Policy
"He's(Neal)not fond of this idea that the courts are the place where policy is made"

    Law:
A rule of conduct or procedure established by custom, agreement or
    authority.
Policy: A definite course or method of action selected from among alternatives and in light of given conditions to quide and determine present and future descisions.
The above was found in the Merriam- Webster Online Dictionary
Looks like law and policy are one in the same thing!
  • The Dictator
Zee Obama court vill make zee policy und you vill like it!
  • what's wrong with the comment?
Sorry, Neal, but I see nothing wrong with the comment. The implication is that she's "telling it like it is", not how it should be ("I'm not promoting, I'm not advocating").

She might well be very liberal, but she might also very well make a good constitutional guardian.
  • Sonia Sotomayor
Yeah, I'd hit it. She has that squinty eye thing going for her. And I really dig older women. mmmmmmmm...squinty eyes...kinda like Renee Zikkwiggler. But seriously by the Democrat standard as long as she has a vagina and her skin tone is darker than everyone else then she is obviously more than qualified. The day after Souter announced his retirement Kirsten Powers was on FOX News saying "...I think he should nominate a woman or a Latino..." How 'bout nominating somebody that's qualified???
  • Sounds like...
The person Obama is looking for will bee no match for Roberts. After the way he made the Elected Officials during his confirmation hearings look like mental midgets.

It will not be long before the "use your feelings' to interpret the Constitution will bite Obama in the ass!
  • Barry's possible Supreme Court nominee
I heard somewhere that a Senate committee needs one Republican to vote in favor of a nominee before that nominee goes on to the full Senate. If the Repubes stand firm, Obama will not get his way.
I wonder if the Repubes are going to be threatened like the GM hedgefunds were.
  • Think About It...
Notice her age and how long she'll be able to "serve".
  • Like...y'know?
"So, like, there was this one time at bandcamp..." That's just great! The more the Democrats water down the qualifications, the lower our standards will be, the easier it is to get the Supreme Court making policy instead of the Legislative branch of our Government. It's so, so...Abby Hoffman and Jerry Rubin would love this! Then there's Janet Napolitano, who makes Janet Reno look hot( may lightning strike me down lest I dare look longingly in her direction! ). Hey, wasn't it the Dems who cried loudly and often over W's nominations? At least they were verifiable adults! How about a female counterpart to compliment Clarence Thomas? Oh wait, he's too, too...uh...not bleeding heart liberal, y'know?
  • Asphalt Ranger
You made absolutely no sense in what you were talking about.
  • hit a hottie?????
how close to 2 a.m. is it?
how much have i had to drink?
    what sign are you?
  • Hit?
What she got hit with was the ugly stick. Regardless of who the lib nominee is, there will be zero entertainment value with the puffy kid glove questions that are bound to dominate the process and the "conservatives" will silently sit back and let it proceed without a peep of protest.
  • eh...
I still say Ron Paul would be a good Supreme Court judge, like thats gonna happen.
As for Sonia? I'd only hit it if I couldn't find anything better at the time. hehe.
  • POSSIBLE NOMINEE
There are just too many real citizens who will defend the Constitution and Freedom.
She is a joke just like the present administration and their nominees.
  • She's a whack job, what fun it would be
Typical liberal nutjob. She routinely insults, berates and shouts at attorneys in her court room in a most inappropriate manner. Her so-called "findings" are questionable and often overturned. To watch her being grilled at a confirmation hearing would be...priceless.
  • Don't overlook what she said
Too many conservatives will overlook what she actually said and just slam her for promoting liberal activist judges. But what she said is spot on accurate, whether you like it or not, and that's been one of the most serious problems we have been facing for a generation, now. Any honest lawyer will tell you that a substantial number of trial judges, not just appellate judges, view it as their right and obligation to do what they personally FEEL is right and "just," not what the law requires. The real problem with it all is that when our judges disregard the rule of law, we are doomed to fall.
  • I agree. She's too hittable to be on the Supreme Court.
  • How do we check-and-balance the courts?
If the courts are watching the law, please remind me how we watch the watchers?
  • Justice Seat
Whomever gets the nod will have to have this bent - and even worse empathy - flushing centuries of law down the crapper.
  • I'd hit it!
