We are sure that you have already heard/read/digested about as much as you can stand when it comes to Obama's Supreme Court nominee Sonia Sotomayor.  You can bet that the Talkmaster will definitely have his say when he returns.  But we can guarantee one thing: Neal wants an up-and-down vote.  Oh, and you know that he will gripe if the Republicans start whining about Sotomayor's position on the dreaded ... abortion ... issue.

 

Just a few quickies to keep you occupied at work.

 

Here's a statement made by Sotomayor that Neal took issue with not too long ago.  He isn't too fond of this idea that the courts are a place where policy is made.   

 

Also floating around the blogs is the notion that Sotomayor is in fact NOT the first Hispanic nominated to the Supreme Court ...

 

The Republicans have known for weeks that Sotomayor was at the top of Obama's list.  They've had weeks to prepare their "attack," and they still can't get it together.  There's a real shocker.

    She will be selected, but we still need to fight the selection for one reason. She is a radical judge, and she is a poor judge. Her opinions have been overturned, time and again, and she doesn't make good decisions.
    If we fight the nomination and expose what she believes, we are also exposing what our beloved dictator believes. This is our only shot of doing so. We are not going to have a vetting of Obama by the media, we are not going to have a review of his policies by the media.
    We should not view this as, give up and let it go or we will antagonize the Hispanics; instead, we should use this as a forum to define the difference between America and liberalism.

    You are confused, but that is okay. Just remember that whenever you are ready to take a vacation from la la land there will be a conservative here to remind you of what made this country great. Make no mistake Copyleft, it is Liberalism that destroys great nations. Not directly, but indirectly. If this country was of the same patriotic mindset that was around just after World War II we would not allow any of what is going on right now to happen. For you to sit there and blindly support Obama (or ANY President) while they help the central bankers liquidate this country that says alot about you. Why are you letting Obama get away with this? If McCain were doing I would be ripping him a new one constantly. Party affiliation don't mean a thing when your very sovereignty is at stake. I am sorry to say this, but our politicians are dividing us and pitting us against each other. Do you not see this? They have no reason to do so right now. This is not the time.     Jackson v. Michigan was overturned on review based partly on a previous opinion written by Scalia Montejo v. Louisiana. The ruling reinforces a previous Michigan court case that once the accused claims the right to counsel, a waiver of that right, and any proceeding statements taken as evidence during subsequent questioning would be invalid unless the accused initiated the communication. In the case of Jackson, the accused was the one who initiated communication leading to the subsequent evidence which supported conviction; and the defendant never requested counsel...but received appointed counsel. When informed of his Miranda rights, he still opted to cooperate. Everything to do with Fifth and Sixth Amendment guarantees right to counsel in a police interrogation, but nothing to do with establishing any policy.

    That's your argument? Please. There is no specific law in my community that says I can't hack up, cook, and eat my next door neighbor if he was already dead when I found him, either (macabre, I know, but it illustrates my point). Common sense dictates the wrongdoing there. Seems to me like the US Constitution is pretty clear on the separation of powers, and the duties of each, regardless of implied or actual written words therein. It's a sorry world in which we live, where "Progressives" think they can twist the Constitution to mean anything they want it to mean (or simply disregard it altogether). Those among us who have taken an oath to defend and uphold the Constitution of the united States should be seriously on alert right now.

Always have been." you imply that the court system, by the very nature of its stated and chartered functions, is made to produce "policy"...which is subjective guidelines. Nowhere did I state that policy has any constitutional license. There is no "GOTCHA" about it...your statements simply show that you do not understand Constitutional law nor do you understand the Constitution.
    Policy does not originate in any court; the public and administrative interpretations of court ruling may drive policy and may affect policy enforcement vis a vis the constitutionality or legality of a particular policy. You have it exactly backwards. In fact, the courts function negates the establishment of policy. This is one reason why citizens who understand the functions of the SCOTUS get crazy when judges "legislate from the bench"...their actions are anathema to the constitutionally mandated functions of the court. Unfortunately, liberals are all too happy to let that happen. I usually give you the benefit of the doubt despite being proven over and again that you neither understand nor care about constitutional premise. THAT is my only mistake.

    Obama appoints an overwhelmingly qualified moderate and the Republicans prepare for whining. Not really a surprise.

    Replacing Souter, he should have chosen a real Warren-esque liberal. Especially with how right wing our Supreme Court is now (and how young most of the right wing justices are), and how extreme the right is in working to curtail our rights.

    Why not tell the justices they're not allowed to wear robes? Or to bar cameras from the courtroom? After all, those aren't explicitly spelled out in the Constitution either!

    Get over it, folks; your "un-constitutional policy" argument fails because, according to your logic, it's illegal for Congress or the White House to set policy too! In fact, it's unconstitutional for ANY policy to exist, because the word doesn't appear in the Constitution!

    I see the liberal blowhards are out in force today trying to justify how their riduculous SCOTUS candidate deserves to be confirmed. What they ignore is that the founding fathers did not intend for the 3 branches of government to have overlapping responsibilities. If I recall, we fought a war of independence(and won) to free ourselves from exactly the sort of political oppression idiots like CopyLeft and his ilk so rabidly endorse.

    Imagine what we'd hear from Copyleft and his ilk if a conservative nominee was quoted as saying "I believe the richness of my experiences as a white male qualify me to reach better decisions than a hispanic female who has not lived these experiences". Oh, the outcry we would hear from those hypocrites.

    In essence, what the libtards are forcing down are throats is the following:
    1) Sotomayor is the essence of quotas as she meets the liberal, PC criteria set forth (female, hispanic, legislates from the bench, pro-abortion)
    2) Despite the fact that 60% of her opinions are thrown out by higher courts, meaning that she is correct only 40% of the time in her decision-making, this doesn't matter because she is a liberal and liberals reward incompetence.
    3) Equality under the law no longer applies if you are a person of color--you now get preferential treatment to the detriment to those of us who happen to be white.

    As she is a chain-smoking, 58-year old diabetic, my guess is we won't have to endure this despicable human being for very long.

    You don't get it, libs like COPY and Barack don't care if it is or is not in the constitution. They fail to see that if it is NOT in the constitution then that must mean they can do it! If it doesn't say specifically they can't, then they will.

    They choose to forget that the President or anyone else for that matter, does not have ANY powers or abililties outside of those stated in the Constitution or given them BY THE STATES. They study the constitution only to find ways AROUND IT.

    But Carlos is right, we must pick our fights, this is indeed a loser.

    Did you even have a rational point? I reread your post several times and it still made no sense. The Supreme Court has long overstepped it's bounds ever since Marbury vs. Madison (look it up) and isn't even supposed to be the final arbiter on the Constitution,,, it has one role "The judicial power shall extend to all cases, in law and equity, arising under this Constitution, the laws of the United States, and treaties made, or which shall be made, under their authority;--to all cases affecting ambassadors, other public ministers and consuls;--to all cases of admiralty and maritime jurisdiction;--to controversies to which the United States shall be a party;--to controversies between two or more states;--between a state and citizens of another state;--between citizens of different states;--between citizens of the same state claiming lands under grants of different states, and between a state, or the citizens thereof, and foreign states, citizens or subjects." read it till you get it

    The SCOTUS, in an opinion written by Justice Scalia for the conservative majority, just overturned Jackson v. Michigan, which basically held that law enforcement can't talk to a defendant who has a lawyer - but not anymore. That my conservative blow hard friends, is called "setting policy".

    Policy is simply what the government does on a given topic. It can be made in ANY branch of government, at ANY level. There's nothing unconstitutional about noting that some policies originate in the courts, because the word policy doesn't appear anywhere in the Constitution!

    And this one is a loser. Obama is going to replace David Souter with a liberal judge. Period. But how much worse can you get than David Souter? By contesting Sotomayer, the conservatives will merely antagonize the Hispanics and women as well as lose and then demonstrate to the world their powerlessness to stop Obama's political machine. They say that Sotomayer is an intelligent woman. Well, perhaps she may even be a better judge than Souter.

    Mike, Heller simply affirmed that the Second Amendment was an individual right, not subject to restriction by the DC laws forbiding personal posession and that the 2A protects an individual's right to possess a firearm for private use and not just for the collective application in regard to an organized militia. There was no establishment of policy, or legislation...simply the interpretation of the Constitution in regard to an unconstitutional law.

    You have no clue do you? The courts are not where policy is made. Show me in the Constitution where it says that. You won't find it. The court's job is to interpret the law, nothing more, nothing less. It's also not the job of a judge to use his or her personal feelings to decide a case. This is something Sotomayor has said that she does. She is dead wrong. But you on the left are too thick headed to understand that the court is to interpret the law their own personal feelings be damned. Her nomination doesn't bother me anyway because she's one liberal replacing another but even Souter new to interpret the law and not do what they feel is right.

    During the Presidential campaign (any of them, actually) we always hear "elections matter." THIS IS (one reason) WHY!

    Republicans need to get over themselves and confirm this highly qualified person to the Supreme Bench. That is Obama's right and duty. Senators really don't have much to say about it. You cannot argue with her credentials. Yeah, perhaps she "sees" the world and the Bench in a different light than republicans - BUT ELECTIONS MATTER.

    Get over it, and maybe next election, republicans (and anti-socialist democrats) will understand what their responsiblities as voters really are.

    Republicans cannot cry about what a liberal-socialist-president is doing, when they couldn't get things straight and organize correctly to win the election.

    Let's just hope a "conservative" Justice doesn't "need to" retire - or we will be screwed. But, still, it would be OUR fault for not doing what we needed to do during election time.

    What Sotomayor said about where policy is made is pretty uncontroversial. That's what appeals courts do, as opposed to trial courts. Or perhaps you didn't like it when the Court made policy by striking down gun control provisions in the Heller case? Or didn't want them to make policy my striking down imminent domain?

    The worst things I've heard about her come from her, and her supporters. They seemed confused about her job and its’ requirements. They tout her as the very things a Court of Appeals or Supreme Court Justice is not supposed to be. Her confirmation on the ‘qualities’ her supporters cite will show we are taking the blindfold off justice.

    They've had weeks to prepare, and they still couldn't come up with a planned, prepped-and-ready, coordinated attack on whoever Obama happened to nominate?

    Why, that's SHAMEFUL. They should be in all-attack mode, all the time! At least, from the talk radio perspective... nothing else makes sense!

    (After all, it doesn't really matter who Sotomayor is or what her qualifications are, or whether she's a good candidate. The important thing is to ATTACK her! She's an Obama nominee and therefore the greatest threat to America EVER!)

    What Neal's missing is that some folks aren't employed by the right-wing hysteria industry. They have better, more intelligent things to do.

    By the way... the courts ARE one place where policy is made. Always have been. But don't reality get in the way of a good, ignorant rant. Gotta keep the outrage engines stoked and running!

    Obama knows he can count on Sotomayor to legislate from the bench. He knows that much of what he is trying to accomplish is highly illegal. He said he will create a brand new "legal czar" as well to make sure his new policies "fall within legal boundaries". All this means is he will hire a legal spindoctor to approve of his actions as he oversteps his authority. I promise you our leaders are VERY worried about the inevitable collapse of our economy. The measures they are taking are just simply preparations for handling civil unrest and possibly full on revolution. If you think I am wrong you need to start keeping up with current events. We are literally only a step away from crumbling like the USSR did. If I was an enemy of the United States I would attack now. The damage would be WAY worse than anything we could even imagine.     I continue to marvel at people that have nothing better to do in life than to attempt to remove every cross in the country.

    My question continues to be; What religion is this 'establishing' in violation of the first amendment?

    If you get past the idea that a religion is actually being established (which I can't), then you have to articulate what religion that is. "Jesus is the son of God" is not a religion. The cross is used by Catholics, Christians, Baptists, Methodists, Church of Christ, and others.

    Which one is this establishing as a state religion again?

    Remember the time, a long time ago now, when freedom of expression superseded freedom from being offended? When it was a good thing to have differing viewpoints? When diversity of thought was celebrated? I miss that America.

    As a country if we cannot get beyond this notion that all things must be unoffensive to all people then I shudder to think what we will become.

    When an artist uses many many colors to create art, it is the harmony (and sometimes disharmony) of the colors chosen that can really set the piece apart.

    If all those colors are mixed together, do you know what you get? A grey brown color that has no life in and of itself. I fear that is where organizations like the ACLU are driving us.
