We had Texas Governor Rick Perry on the show recently after supporting a Texas House resolution reaffirming states' rights under the Tenth Amendment of the Constitution. Yesterday the Governor attended three tea parties around his state where he made this statement:

"There's a lot of different scenarios ... We've got a great union. There's absolutely no reason to dissolve it. But if Washington continues to thumb their nose at the American people, you know, who knows what might come out of that. But Texas is a very unique place, and we're a pretty independent lot to boot."

Can Texas secede from the Union? There are some who believe so. Texas, you see, became a state under the provisions of a treaty. Whatever that treaty dictates is, in effect, the law of the land. Parties to treaties dissolve their relationships all the time; who's to say Texas cannot?

    The left would be pushing for Texas to secede. That state is a guaranteed 34 electorial votes come every election. The GOP losing those 34 votes would be a massive loss for them. Capturing FL or OH (the main two swing states) would no longer be the win(s) that put them over, it would just be enough to break even with Texas' loss. In fact, the GOP would need a Regan style sweep to ever win the White House again without Texas.

    has the right to secede, just like every member of your neighborhood has the right to move out. It's only a "neighborhood" because a bunch of "neighbors" elect to live there; it's only a "United States" because a bunch of "states" agreed to be "united", not because some other entity simply appeared above it. Three of our original states (which, it should be noted, were listed as independent victors in the Revolutionary War in the Treaty of Paris) actually had stipulations to their ratification of the Constitution that they could leave at any time. So, the only thing preventing that is the reasonable fear that Washington will rape, pillage, and murder any state that tries to leave. Again.

    The Constitution specifies how a State may be admitted to the Union (Article IV, Section 3). It does not say how a State may leave the same. Nor does it prohibit it.

    Lincoln's war against the southern States did not make leaving the union unconstitutional. It just showed that the northern States had more war making capability and killed a bunch of people on both sides.

    The problem with this is that after joining the US, there was the Civil War. Now granted, Texas is rather odd in that it had sons that fought on both sides, and I believe is also the only southern state to have had memorials built to soldiers on both sides of the war. But the state did secede because of the very real geographic quandry, and when Texas was re-admitted later on, the new rules neither allowed for fragmentation nor re-asserting sovereignty.

    It's just a shame most Americans (particularly on the left) are so ignorant of history and civics that they are unable/unwilling to see or accept that they are being subjugated and oppressed by a tyrranical federal government. Maybe if they read a book every now and then instead of turning on American Idol, we'd be living in a different world where the majority of the populace rejected the uneven and overreaching hand of the federal bureaucracy.

    If Texas goes, other states may follow. And if you lefties think that secessionism is only something that gestates in right-wing, Republican, and/or southern states, then take a look at some very heavily Democratic "Blue" states where a similar sentiment is brewing. Start with Alaska, then look at Hawaii, then go take a look at Vermont (among others). They're all sick of the tyrrany of Washington DC, so it will indeed be interesting to see what happens if Texas bows out.

    This guy obviously never studied and his parents paid the teachers for passing grades. That is the only reason I can think of for him not knowing what happened last time states seceded from the union.

    In a quiet, unassuming little country called Venezuela, the one state that has the most wealth, the resources, and the smarts and cojones to make a stand, Zulia, has been a thorn in Hugo Chavez' culo! The port city of Maracaibo has shopping malls, restaurants, oil pipelines, clean streets, realtively (ahem)uncorrupt police,( did I say it had oil?)...pretty much everything the rest of the country does not have. It's kind of like...like...Texas! And the best part, Chavez made a huge deal of telling them he would cut the state off from 'Government aid'. They are still laughing at him. Doesn't it sound a little like Texas? I guess you'd have to have lived in Texas to appreciate the experience. The bottom line is, seceding isn't completely feasible, but the state could get along just fine if the the Federal Government kept it's Leon Panetta sized nose out of it's business. ( Oh, all you left wing haters, I have a big nose...untwist your bloomers, relax your sphincters!)Yew tell em Ricky!

    I believe this is the first of the rumblings for seceding from the union. I've been predicting this for a while. The first states will leave around 2030 and bascially all of "red country" will form a new country leaving the West Coast and Most NorthEast in the "old" government. California will secede from that later. I see 3 countries existing by 2050. We'll just have to see if I'm right.

    Technically yes, the State can secede under the 10th amendment, but Texas vs. White stands in its way. It was very controversal ruling and is open for over-ruling.

    the prospect of Texas once again regaining her sovereignty is intriguing, to say the least. All this talk from disgruntled liberals saying that Texas can't secede is nonsensical. To quote them, "YES WE CAN". Time to look into getting a Republic of Texas passport?

    Allow me to clarify something for you... America is a Union of States. If a State talks of leaving the Union, that makes it anti-American, right? I'm pro-American, I'm Texan, and I like the fact that I'm part of America. If I don't like what government is doing, I have the right to vote for someone else. In this case, I’ll bet my hat that many other Texans share my perspective and will elect Hutchison over Perry in the next election. Our state may have the right to secede from the Union, but we saw how well that went over in 1861 when all those anti-American states decided to form a Confederacy, and I don’t anticipate us repeating that error.

    Texas is not the only state where this specter has arisen; there has been talk in Alaska about suing the federal government over violating the terms of Alaska's statehood compact. This is an interesting case that would be very difficult for the federal government to defeat in an honest and unbiased court.

    I do not beleive Gov. Perry is actually serious about Secession, unless he wants to be the "President" where he feels he can get elected. Perry stuck with some very unpopular policies (the Texas Corridor) and is trying to provide political cover. I don't know if he is politically brave enough to open the Texas Independence can of worms.

    Many Texans I have talked to, (multigenerational Texans whose families have been here over fifty years- mine included) have always toyed with the idea of secession, and I don't know a single one that would be against it. I think the biggest problem would be getting the Federal Government to realize they just lost a large portion of their power because of their irresponsibility. (Like disciplining a teenager. They want to be irresposible but still want to be trusted with responsibility.)

    You betcha Texas still has the right to secede if she wants to. Texas has several unique rights that other states do not have as conditions when it joined the United States in 1846. Hell, we could even decide to split into five states if we really wanted to, but it ain't gonna happen.

    Washington should study the Texas economy. We are getting it right. We do not have an income tax, but instead a sales tax. We make a boatload of money this way, partly because all the illegals have no way around avoiding this tax. If we had a national sales tax in lieu of an income tax, the US would solve a lot of the budget problems they're having. Man, now I'm fired up about some of the other comments on here...I need to go blog about this!!! :)

    BTW, Robin, we didn't come a callin' on the government after Ike. We have taken care of ourselves just fine...way better than New Orleans that is still jacked up nearly four years after Katrina. If you sit around and wait on the government to do something for you, it'll never get done (or done at a glacial pace with less than desireable end results).

    But in any case, I really hope Texas does secede. Go for it. Just don't come begging to your Northern neighbors when you need something. We'll me mighty fine without you. And while you're at it, take a few neighboring states with you. Y'all still live in a pre-1860 mentality anyway, so continue that way.

    What is un-American is sitting there & saying, "Whatever the government wants to do is OK, because they're the government." If our founding fathers had had your attitude, we'd be English -- and you would be Mexican.

    Well, I'm a Texan. Now, this may come as a shock, but no one in Texas was talking about secession until Perry opened his trap and made us all look like anti-American nutjobs. All my coworkers were like "what the hell is he talking about? where did he get this idea??" What this amounts to is Perry trying to make a big impression with the right because he knows he's up for reelection and Kay Bailey Hutchison is going to walk all over him. This was a one-man show, and he does not have the backing of any significant amount of the population. Please, pay no mind to our lunatic Governor, we have a history of electing them down here. At least our last Governor was doing a good job before he was sent to Washington, where he then began to display signs of being a total screw-up.

    Copyleft says "that this "right to secede" nonsense is a myth". If copyleft was around in 1776, he would have been a stinkin' Tory. I think secession begins with a simple letter written to the powers that be. I think that letter would begin with something like, "When in the Course of human events it becomes necessary for one people to dissolve the political bands which have connected them with another....." and then you just have to back it up. That's another story. It may not be so hard now though, I don't think the current administration has the resolve of a King George or an Abraham Lincoln.

    States indeed have the right to secede. Its amazing to me that some people actually think the civil war was about slavery and Lincoln wanting to free the slaves. The civil war was about states rights and the states resisting Lincoln the tyrant and his centralized government and special interests. Sound familiar?(Bush/Obama). Lincoln in truth did not like us blacks one bit. Read through the man's old speeches and you'll see the racist white supremacy in them. Lincoln wanted blacks out of America, and did not want blacks in the west.He even jailed people that disagreed with him.It amazes me that Obama looks up to Lincoln, when Lincoln would have thought Obama to have inferior genetics. Bravo Texas, hopefully other states follow your lead.
  • A little Real History
    The United States was about to go to war with Mexico. Admitting Texas to the US would simplify logistics in that endeavor.

    Texas, at the time, was deep in debt, and looked to joining the US if the US would pay off Texas' debt. That was written into the treaty.

    As it's own country, Texas legally had to join by treaty. However, the treaty was not ratified by Congress with the required 2/3 majority. The debt was the main reason for the failure.

    Instead, congress made a "joint resolution" admitting Texas to the Union (illegally, in my opinion), which only required a simple majority. The joint resolution passed, and Texas was "admitted" into the US.

    And true Texans will continue to regret that day.

    Right to secession is not a myth. It's central to a free society that governments exist by the consent of the governed...and if we no longer consent we can cast off.

    'No right to seceed' and 'eternal union' was ape lincoln's philosophy and he invaded, subjugated, and killed millions of American citizens to that end. Why we deify lincoln is beyond me.

    For good, scholarly works on secession please read "When in the Course of Human Events" by Charles Adams and "A Constitutional History of Secession" by John Graham.

  • Not likely, but if only
    There are three parts to how Texas came into the Union. First, yes Texas came in under treaty and we could have disolved it at any time. However, after the Civil War Texas came back into the Union just like every other State, the treaty was no longer in effect. Third, for Texas to leave we would have to find at least two other countries to support it. I think Russia would be the first to get back for the US support of some of the countries that have broken from the old USSR.

    Is it possible? Yes. Do I want it to happen? Yes, but with reservations. Do I want Rick Perry leading the state at the time we do it? Hell no! I would love to see a vote on the issue to see what the people of Texas would be willing to do.

    The attempt to resist unfair taxation and federal abuse was tried over 150 years ago. History and those with agendas twisted this into a war over slavery. Today the same abuses are taking place with the excuse of helping another allegedly abuse class (the poor). Just another wealth transfer disguised as social justice.

    One of his points was that Texas has a great economy- an Economy that is so booming because American companies like to be based there (for tax reasons, of course). Leave America, and most American companies would leave Texas. Texas' economy would dissolve overnight.

    Texas' admission to the union allowed for the possibility of breaking up its territory into four additional states, but nowhere was a "right to secede" mentioned or acknowledged.

    And the post-Civil War Supreme Court rulings on states' membership in the Union put the cap on the notion that states somehow have a "right" to secede.

    Not that I wouldn't be glad to see such a clueless, backward state depart from this country... but we're stuck with 'em.

    The constitution is an agreement, a contract between the citizens about how we will govern ourselves. If that contract is egrigiously (sp?) broken, its over. We are no longer bound to it. Our Founding Fathers would have revolted ages ago. Mind you if our founding fathers were writing a constitution now a days, it would not be one that creates a democratic republic. They would create something more like an oligarchy. They knew that a democratic government is only doable for a people that are educated and self-governing. 'We the people' of the 21st century are not the same people who ratified the constitution 200 plus years ago. Such a shame. (liberals, please don't bring up slavery and such, it would only show how historically parochial you are)
