OBAMA'S WORST CABINET APPOINTMENT

After careful analysis, and many instances of mind-numbing stupidity ... I have determined that Janet "Nitwit" Napolitano is Barack Obama's worst cabinet appointment. Just take this little moment she had over the weekend. An interview on CNN has Napolitano explaining why Democrats want to investigate Sheriff Joe out there in Maricopa County Arizona. See if you can catch what is so blatantly wrong with this statement:

Well, you know, Sheriff Joe, he is being very political in that statement, because he knows that there aren't enough law enforcement officers, courtrooms or jail cells in the world to do what he is saying.

What we have to do is target the real evil-doers in this business, the employers who consistently hire illegal labor, the human traffickers who are exploiting human misery.

And yes, when we find illegal workers, yes, appropriate action, some of which is criminal, most of that is civil, because crossing the border is not a crime per se. It is civil. But anyway, going after those as well.

Did you catch it? Ok, I'll spell it out for you: "crossing the border is not a crime per se." And this is from our head of Homeland Security? Hey, Amigos! All you people down there on the border just waiting to cross! Forget about visas! Forget about going to those pesky and troublesome little checkpoints. Just walk on over! It's not like that is illegal or anything! Viva Napolitano!

What others are saying

  • Crimial vs. Civil
    hey SloppyLeft;
Criminal cases are prosecuted by the state; where civil cases are brought by corporations or individuals. If crossing the boarder is a civil case, why is the state (fed govt, state govt) prosecuting the violators? Your O.J. example is typical of uneducated leftist. The state (CA govt in this case) could not convince the jury beyond a resonable doubt to convict him of murder (criminal act), but by a preponderance of the evidence he was found responsible in a case brought to court by the family...not the state. By the nature of the circumstance, it is the state and not individuals who are bringing "cases" against people who come into this country without permission...or illeagally for those in Rio Linda.
  • Copy you contradict yourself... again
Under the water boarding comments you said we are a NATION OF LAWS. Now you say we aren't???

Be consistent. Here's a tip, try using references to reinforce your argument instead just using your opinions.
  • RESIGN or FIRED
Time to call for her resignation or be fired since she will not do her job. She has admitted that she will not do as she swore and uphold the Consitution and Laws of this nation.
  • I just called the DHS to complain. I was shuffled into a voice box that was so full it wouldn't even take msgs. Nice response from our government. I guess they aren't responsible for anything.
  • Copy
That was really stupid. OJ wasn't "prosecuted" on civil matters, it was a "lawsuit". You can pretty much sue anyone you want, for anything. Depending on the judge and jury mentality, that's what determines the outcome. Now, go back and study criminal law.

And I don't think we should just put the illegal aliens back across the border. We should take them to the furthese southern point of Mexico so they at least have the longest way to walk back to attempt it again.
  • Janet Napalitano
Hey,what do you guys want from me? I realize she is a bad pick, but what do you expect? Its not like I have a lot of experience making executive decisions. You all knew that when you elected me!
Give me some time, man,I am trying to learn here!
Boy, this president stuff is a lot harder than community organizing...all I had to do there was get a bunch of people together to complain the those in charge. Now it be me,its tough.
  • ???????????????????
If it is not against the law to cross the border without being documented then why do people need passports to enter the United States?
  • Copyleft, read the damn law
Crossing the border illegally is a crime. Civil penalites can be added to the criminal penalties. It isn't an either or deal in this case, it is both.
  • To Copy
Since when do we incarcerate people for civil infractions? Like I said I saw hundreds of illegals do prison time for entering the country illegally.

Read the law from the "Criminal" not civil code I and others have posted.

Now, go back to Huffington dumba**s
  • Janet Napolitano
Let me be the first to call for her resignation. She is not of the quality that is necessary for the job she fills.
  • the mind of a liberal
Qualification and Justification are halmarks of the liberal thought process. There is infinite flexibility for someone who recognizes no set example/authority (rule of law). The fact that these thoughts all appear IN THE SAME SENTENCE, says it all: "...illegal workers...some of which is criminal...not a crime per se..."
    UNBELIEVABLE
  • Narcissistic
There is no surprise from Obama. He is part of a Nacissistic generation, not the greatest. and politically he continues to drag Bush back in rather than looking forward. Did I say the definition of narcissistic?
  • national security
This idiotic woman's main duty is NOT to determine what's illegal and what's not. It is to ensure and protect this nations national security. The border is a real, vital and critically importaant national security issue. Not only does she (And Obama) not want the border secured, she wants to investigate one of the few government officials working to enforce it!
  • TO: Retired
You should try some education yourself. Civil and criminal law are two different things, and being here illegally is a CIVIL violation.

That distinction, for example, is why O.J. Simpson was forced to pay damages for a wrongful-death CIVIL suit, even after he was acquitted in a CRIMINAL murder trial. Two different areas, two different sets of law.
  • Illegal Aliens
    (a) Improper time or place; avoidance of examination or inspection; misrepresentation and concealment of facts
    Any alien who
    (1) enters or attempts to enter the United States at any time or place other than as designated by immigration officers, or
    (2) eludes examination or inspection by immigration officers, or
    (3) attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact, shall, for the first commission of any such offense, be fined under title 18 or imprisoned not more than 6 months, or both, and, for a subsequent commission of any such offense, be fined under title 18, or imprisoned not more than 2 years, or both.
    (b) Improper time or place; civil penalties
Any alien who is apprehended while entering (or attempting to enter) the United States at a time or place other than as designated by immigration officers shall be subject to a civil penalty of—
    (1) at least $50 and not more than $250 for each such entry (or attempted entry); or
    (2) twice the amount specified in paragraph (1) in the case of an alien who has been previously subject to a civil penalty under this subsection.
Civil penalties under this subsection are in addition to, and not in lieu of, any criminal or other civil penalties that may be imposed

This was taken from the US code

A civil penalty can be added to the Criminal penalty
  • Illegals
Woo hoo!! I was waiting until I became a citizen of the US to attempt to bring my family LEGALLY, but if Mrs Napolitano thinks it is not a crime to come to this country illegaly, my family reunion may happen sooner than expected!!
  • Now I'm confused
If entering the country illegally is NOT a crime, but instead a civil violation, how can we deport ANYONE? How can we raid workplaces and gather up the "undocumented workers" and ship them out? Maybe we should just SUE them! Come on, people. It's either against the law or it isn't! We're not suggesting that Napolitano arrest and JAIL these people. We want her to arrest them and SEND THEM HOME! And then create tighter border security to prevent them from coming back! And I'm not talking about JUST the border with Mexico.
  • Napolitano
Typical. The Obama administration is sucking up to La Reza and other "Immigrant Activists". She needs to learn (and enforce) the law. You can't fight terrorism, sorry...man caused disasters, if you can't secure your own border.
  • Happy Day in AZ
I'm with you on this, Boortz. My son lives in AZ and is very happy Ms. Nappi is no longer governor there. She loves the illegals and hates law inforcers. Unfortunately AZ loss is our -- gain???
  • Wrong Link
Here's the rest of what I intended to show with that link. There are civil penalties in addition to the criminal ones, not in lieu of them"

Section 1325 [of Title 8, Chapter 12, Subchapter II, Part VIII]. [U.S. Code as of: 01/06/03]

    Improper entry by alien

    (a) Improper time or place; avoidance of examination or inspection;
    misrepresentation and concealment of facts
Any alien who (1) enters or attempts to enter the United States
at any time or place other than as designated by immigration
officers, or (2) eludes examination or inspection by immigration
officers, or (3) attempts to enter or obtains entry to the United
States by a willfully false or misleading representation or the
willful concealment of a material fact, shall, for the first
commission of any such offense, be fined under title 18 or
imprisoned not more than 6 months, or both, and, for a subsequent
commission of any such offense, be fined under title 18, or

enter) the United States at a time or place other than as
designated by immigration officers shall be subject to a civil
    penalty of -
    (1) at least $50 and not more than $250 for each such entry (or
    attempted entry); or
    (2) twice the amount specified in paragraph (1) in the case of
an alien who has been previously subject to a civil penalty under
    this subsection.
Civil penalties under this subsection are in addition to, and not
in lieu of, any criminal or other civil penalties that may be
    imposed.
  • Idiot Boss, Idiot Appointees
The real horrible unbelievable idiots are the people who will give this naive clueless wussy another 4 years in 2012.
  • Mexico's example
I say we secure our southern border the same way Mexico secures their southern border, if it works for them why don't they want us to do it? Oh, yea I forgot. The money sent back to Mexico from the US accounts for the third largest income stream for Mexico.

So it's ok to pick and choose which civil laws people choose to obey? Tell that to your local police next time you break a civil law and see how far that gets you.
  • Only criminal infractions carry jail time
Crossing the border of the US without going through a immagration check point or inspection is a criminal act. If you look at the federal code below you will notice that such an act can land you in jail. Please get a clue.

Section 1325. Improper entry by alien

    (a) Improper time or place; avoidance of examination or inspection;
    misrepresentation and concealment of facts
Any alien who (1) enters or attempts to enter the United States

officers, or (2) eludes examination or inspection by immigration
officers, or (3) attempts to enter or obtains entry to the United
States by a willfully false or misleading representation or the
willful concealment of a material fact, shall, for the first
commission of any such offense, be fined under title 18 or
imprisoned not more than 6 months, or both, and, for a subsequent
commission of any such offense, be fined under title 18, or
imprisoned not more than 2 years, or both.
    (b) Improper time or place; civil penalties
Any alien who is apprehended while entering (or attempting to
enter) the United States at a time or place other than as
designated by immigration officers shall be subject to a civil
    penalty of -
    (1) at least $50 and not more than $250 for each such entry (or
    attempted entry); or
    (2) twice the amount specified in paragraph (1) in the case of
an alien who has been previously subject to a civil penalty under
    this subsection.

Civil penalties under this subsection are in addition to, and not
in lieu of, any criminal or other civil penalties that may be
    imposed.
    (c) Marriage fraud
Any individual who knowingly enters into a marriage for the
purpose of evading any provision of the immigration laws shall be
imprisoned for not more than 5 years, or fined not more than
    $250,000, or both.
    (d) Immigration-related entrepreneurship fraud
Any individual who knowingly establishes a commercial enterprise
for the purpose of evading any provision of the immigration laws
shall be imprisoned for not more than 5 years, fined in accordance
    with title 18, or both.

  • ILLEGAL ALIENS
If crossing the border is just a "civil" infraction, home come the Federal Prison I worked had hundreds of "illegal Aliens" incarcerated over a 20 year period for nothing more than crossing the border illegally?

Get educated Copy, crossing the border illegally is a criminal offense.
  • The biggest Nitwit...
Well, it's a close call, but I guess I'll agree that Napolitano is the worst appointment so far. But the biggest Nitwit of all is the one who occupies the White House. Sometimes I wonder, who the hell is advising this guy? Or is he really that clueless; or just narcissistic?
  • Civil Infraction
Sorry Boortz but Mrs. N is correct crossing the border is not a criminal act. However, crossing the border with illegal materials such as weapons and drugs is a criminal act.
John Stossel did a wonderful report on the border which I recommend to any critical thinking person out there. In the report he reminds us that the 9/11 hijackers came in to the country with student visa's not over the southern border.
  • Wrong as usual
Napolitano's statement was completely accurate. Violations of civil law are NOT crimes.

You're a lawyer, Neal. Why are you pretending not to know this?
  • Neal, how did you choose the worst?
Wow, Neal, I'm impressed that you are able to determine the "worst" among that gang of misfits. How did you manage to choose Napolitano over this crew:

-- Secretary of State Hillary Clinton, who believes the billionare Mexican drug cartels pay full retail for 90% of their guns at mom and pop gun shops in Texas that don't even sell actual assault rifles -- instead of getting a volume discount for the real thing from an actual arms dealer.

-- Chief of Staff Raum Emanuel, who thinks a national financial crisis is something too good to waste (by actually fixing it).

-- Attorney General Eric Holder, who thinks we're a nation of cowards

-- Secretary of Treasury Tim "Tax Cheat" Geithner, who can't seem to make up his mind how best to destroy the American banking system.

-- Vice President (and Clown-in-Chief) Joe Biden, who admires FDR for his televised fireside chats (10 years before the invention of TV)
  • For shame, Neal
Once again, you're exploiting your audience's (admittedly reliable) ignorance when you, from your own legal training, already know better!

Napolitano is, of course, 100% correct. Breaches of civil law AREN'T crimes. Neither are breaches of contract, for example.

You're using the popular notion of "crime"--i.e., anything that violates any law--as a trick to try to make Napolitano look like she's saying civil violations aren't really illegal. AND YOU KNOW BETTER THAN THAT.

So what you're doing here is taking advantage of people's ignorance to deliberately mislead them with a distortion of the facts. In other words, classic talk raido.

Now for the fun part: let's sit back and see how many fall for it!
  • AT LEAST THOUGH....
the South Korean border is being protected with billions upon of U.S taxpayer dollars. In fact its one of the most militarized borders in the world. So at least they are good to go. Oh yeah and at least Israel's borders are protected with billions upon billions of tax payer dollars that America doesn't even have...right Neal? In fact America has racked up 11 trillion in debt, quite a bit of it from military parternalism, nation building and trying to police the whole planet. The Islamic terrorists are laughing to themselves watching America driving itself into the ground on purpose, while they use American military presence in the middle east as a convenient and effective recruitment tool. People wake up, the so called 'war on terror' is absolute nonsense. The same people saying there is a war on terror are the same ones who OUTRIGHT REFUSE to secure the border. If they are SOOOO AFFRRAIID of islamic terrorists coming into the country to do harm, then why not secure the border? Maybe we need a team of oragatans out there to work around the clock doing research and analysis to come up with a report for the American people(Neal,Hannity and Limbaugh included) to let them know they are being had with this whole 'war on terror' nonsense. Neal manages to complain about both problem and solution. Just think if we gave the American border even a TENTH of the attention and weapons Korea and Israel get...? And by the way, Mexicans treat people coming into Mexico from central American countries as criminals. Go figure. Look up the fall of Rome, and compare it to what America is doing to itself, the similarities are chilling.Rome tried to police the known world too.

    And yep...Im a conservative voter.
  • Viva Napolitano!
I can't believe she went beyond saying she some activity illegals engage in is criminal. It's all illegal. The law does not have an opinion on their intentions or backgrounds or how our nation was founded.

Are politicians playing it so close to the middle that neither side is willing to address the issue of illegal aliens and risk losing the Mex-Am voting block?
  • Janet Napolitano
Are you kidding me? How is this woman allowed out without a straight jacket? I think she should record her statements before hand and listen to what she says before she opens her mouth in public.
  • what's wrong?
I figured this was the part that's wrong:

What we have to do is target the real evil-doers in this business, the employers who consistently hire illegal labor, the human traffickers who are exploiting human misery.

Granted, the employeers who hire the illegals are certainly contributing to the problem. But to label them as "human traffickers who are exploiting human misery" is ridiculous. The would only be human traffickers if they were forcing the illegals to come here and work against their will. The employers definitely aren't. They are simply offering better jobs than what they would find in Mexico. In that respect, these employers are doing the illegals a favor.

No, I am in no way defending illegal immigration. I'm just pointing out that Napolitano's comment is way out of line.
  • Inconsistent
I thought they didn't want to enforce the I9 regulations anyway? And Pelosi wants to stop the jobsite inspections so how are we supposed to "target" the employers???? And the TARP money can be used for illegal alien labor????

This makes no sense. Janet needs to go along with many others.
  • Janet's Statement
Neal, I understand the statement about crossing the border isn't a crime per se, but she also blames the employers as the "real evil doers"
  • cossing the border
Crossing the border, without going through the proper procedures, is not illegal??????? This is way to mind numbing for this early in the morning? Civil crime? Unbelievable!!!!!! Sorry if spelling is bad.
