A TENTH AMENDMENT COMMISSION

Yesterday we have Governor Rick Perry on the air to discuss his current efforts to reaffirm states rights as guaranteed under the 10th amendment. Here's a brief bit on what he had to say:

"I believe that our federal government has become oppressive in its size, its intrusion into the lives of our citizens, and its interference with the affairs of our state ... That is why I am here today to express my unwavering support for efforts all across our country to reaffirm the states' rights affirmed by the 10th Amendment to the U.S. Constitution. I believe that returning to the letter and spirit of the U.S. Constitution and its essential 10th Amendment will free our state from undue regulations, and ultimately strengthen our Union."

I couldn't agree more. And this one has to go into the category of "I told you so." I proposed in my book, "Somebody's Gotta Say It", the idea of a Tenth Amendment commission. It is absolutely the most widely ignored and abused amendment in our Constitution. Statists see the 10th "Amendment as nothing less than a potential barrier in the way of an ever-growing government ... at least that is what a lot of Democrats would have you believe.

If Democrats had their way the 10th Amendment would be repealed immediately. There should be no limits whatsoever on the power of the federal government. The Supreme Court has pretty much taken care of that for them.

    Republican leaders use the "we need change" crap just as much as liberals do. I agree with the change that republicans say they want, but I am not buying it. You cannot say one thing and do another. We call liberals dumb for believing Obama's BS, but then we eat this up? Come on people, we should know better.
    I am all for smaller govt. I am wholly Libertarian, but I am also not blind.

    Uriel - Absolutely right! Our "unenumerated rights" have almost completely vanished.

    Joyce (and Neal) - PLEASE do not refer to "States' Rights!"

    Under our constitution, States have NO rights; they have POWERS. Only individuals...us..."the People"... have rights. NO rights are granted government at any level.

    You play into the hands of the statists when you use a misnomer like "States Rights". That phrase was, for decades, the rallying cry of segregationists. The statists will brand you a racist for using this misnomer and use your misstatements to encourage their fellow travelers to believe you are dangerous and need to be brought under greater control of the state.

    If we are going to insist that government return to carefully following the constitution, we must do so ourselves.

  • Why don't 2/3 of the STATES abolish the 17th Amendment...
    and start electing US Senators again! Granted I'm not "up to snuff" on the Constitutional amendment process, but do we have to wait on Congress to start it? Seems to me if the States were really interested in taking back their sovereignty, abolishing the 17th would be a great starting place. Then maybe they could go about the same process and abolish the 16th and institute the FairTax! :)

    Heck the problem goes back further then Teddy, Davie Crockett made a speech against what we now call earmarks when Jackson was president.

    "The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people."

    Now, this is absolutely the most widely ignored and abused amendment in our Constitution. The Tenth is in second place to this by a mile with all political parties!

    It is true that Perry has hardly been the model of Small Government Conservatism but, At the very least it is the right idea and if we need to spend time looking for a politician with a spotless record on either performance or orthodoxy to start the ball rolling. We will be waiting forever. The key is to start and broaden the debate. Hopefully that will wake up some people that this is not the way the system is suppose to work.

    Right you are Bob, I stand corrected, it was Roosevelt who kicked it off!!!

    Mark, I believe Perry said "without strings attached". He's not turning down help, unless they want to attach conditions. But if so many Texans are saying to watch out, then I myself anyway will be watching carefully.

    So far I haven't found any negatives with Mark Sanford in South Carolina!!

  • Perry's indignance is a joke wrapped in hypocrisy
    "RHETORIC VS REALITY.... Following up on an earlier item, Texas Gov. Rick Perry's (R) speech yesterday on his unwillingness to accept the "oppressive hand" of the federal government has caused something of a stir. It also, as it turns out, offers another example of conservative hypocrisy.

    After all, there's Perry's rhetoric...

    "We think it's time to draw the line in the sand and tell Washington that no longer are we going to accept their oppressive hand in the state of Texas.     I visited Washington DC on the 4th of July this year. Guess which government building in DC looks the most run down? The Org of American States. Its across the street from Consitiution Hall.

    Being from Texas, Rick Perry is nothing but a hypocritical opportunist. Where was all this talk about the 10th Amendment when George W. Bush was growing the size of the government faster than almost any other president in modern U.S. history.

    Just goes to show, Republicans are only for small government when they aren't in power.
  • Rick Perry talking like a great conservitive
    I hear clips of Rick Perry speaking yesterday and I admit that he said the very things I wanted to hear from anyone elected to office, but this is Rick Perry. Slick Rick will say what ever he belives will keep him in office. He can see the light and he wants in on the glory, don't trust him. Now, don't misunderstand I don't really like Kay Baily either and I really wish Kinky would go away, but Rick Perry is no conservitive hero. He is oportunistic and a showman.

    Remember, Perry is the Gov. that pushed to have every public school girl vaccinated with an unproven drug to prevent a virus which may cause cancer. I am all for preventing and curing cancer, but why force this on kids against the parents will?

    In short, I'm still not impressed with my Governor.

    Goldman Sachs is able to pay back it loan because is received a great deal from AIG who was insuring their losses.

    NJ Governor Corizine (sp?) is past president of Goldman Sachs. I believe they also manage Clinton's charity's money.

    They are able to pay back their bail out money with AIG's bail out money...

    The government for the most part, the media and lefties don't get it. We are tired of it ALL. Since Woodrow Wilson we have drifted further and further away from the Constitution. We want our country back and want the Federal Government to back off and let the states run things as it was meant to be!!!

    Politicians are OUR employees and come 2010 many will be looking for new jobs.

    Could being in favor of the 10th Ammendment (the state sovereignty movement) put you in the crosshairs of the DHS' guidelines because of "rejecting federal authority in favor of state or local authority"?

    Last week you suggested a third party. What about the idea of a Constitutional party whose expressed mission is to return this nation to it's constitutional roots.

    Along with this we need a conservative version of the ACLU whom ONLY pursue constitutional issues.

    This is awesome to see states beginning to assert 10th Amendment rights. Thanks Ron Paul for popularizing the constitution movement.Hopefully other states will follow suit, and I hope those governors that do this aren't considered "radical right wingers" by the federal government for acknowledging and wanting to follow the rule of law. Next up organizing and training state militias.

    Make no mistake if Mitt Romney, Il Duce Giuliani, Komrad Juanito Mccain, and Darth Cheney had their way, the 10th amendment would be repealed. Oh wait....that's right you DID say democrats.....
