A NATIONAL CYBERSECURITY ADVISOR?

Have you heard of the Cybersecurity Act of 2009? It has been proposed by Sen. John Rockefeller and Sen. Olympia Snowe. This is a bill that would give the president the ability to "declare a cybersecurity emergency" and shut down or limit Internet traffic in any "critical" information network "in the interest of national security."

Many questions pop into my mind. But let's start with one. What exactly is considered a "critical information network"? (Other than Nealz Nuze, that is.) Well ... that could include a lot of private sector entities like banking, telecommunications, utilities and others. But that will be up to the president to decide.

Now listen to this ... this bill also grants the Secretary of Commerce "access to all relevant data concerning [critical] networks without regard to any provision of law, regulation, rule, or policy restricting such access." Without any provision of the law?? There's that "rule of law" thing at work again. If this were Bush we would have Democrats screaming about warrentless this, that and the other thing.

And it establishes - you guessed it - more government! The Office of the National Cybersecurity Advisor that would take the lead on Internet security matters and coordinate with the intelligence community and the private sector.

Take a look at the bill for yourself ... tell me if you think this is benign, or if you think that we're looking at a power grab and intrusion into the private sector and your private lives.

    I might have read the bill wrong, but....It appears the government has possibly found a way to tax and make money off of the internet...in the name of 'security.' They've been trying to figure out a way to do this for years. Why would the gov't care if small businesses' computers get a virus and/or crash? For small and large businesses to be able to meet these so-called gov't-mandated security standards, it will require access and use of special ("safe & secure") gov't licensed domains, which will naturally come with access fees, and eventually taxes added for services, time on the internet, and anything purchased over the internet.

    Obviously, the president does not have any Network Engineers or NE students advising him...if they did, they would bring shame to us Network Engineers and NE students who know that: The ARPANET - the precessor to the Internet- was BUILT and DESIGNED to be reliable when any kind of attacks came upon it. Read the works of Paul Baran...read the works of early computer scientists. That is what the ARPANET and Internet was built to do. To be reliable. To control the dissemination of information. That is what dictators do. That is how you control - control the spreading of information. Heed my words. They are true.

    Whoa...not just executive branch agencies but to all of these areas. This is akin to Martial Law by the Executive branch, something that has previously been ruled unConstitutional in ex parte Milligan.

    Only Congress should have that power, not the Executive. I could see a window of 48 or 72 hours to apply such, giving Congress time to assemble and make a ruling, but having this power given carte blanche to the Executive branch is IMHO unconstitutional.

    How priceless. The Internet's predecessor, the ARPANET, was built upon the premise of a redundant network that was deliberately built to be operational DURING an emergency to keep multiple routes of information accessible under the idea that more communication access was better.

    That's like legislating that fire trucks should be used to *start* fires.

  • Sneeky stuff
    As I read this, it opens the door for the Fed to stick its nose into any and all private firms that develop software or computer systems to insure that whatever is produced is "secure" according to government standards. I was also struck by the proposal to prohibit anyone except those holding government issued licenses from working in the field of cybersecurity in the federal government or other entities that deal with the government. Big Brother keeps growing.

    The establishment of another government controlled tool to control the population isn't really a surprise. From the refusal of the Obama administration to accept repayment of TARP funds, to the recent establishment of a "world currency", Obama is clearly working to circumvent and, in the long run, destroy the concept of a government restained by a Constitution.

    Unfortunately, Franklin was right when he told the young lady that we had a Republic, if we could keep it. It seems that we have now lost it, and the American experiment is ending without more then a whimper. Is a modern Monarchy now our future?

    The are coming at us in every direction even more quickly than we thought they would.Sounds like they are following the Communist Manifesto.I always thought of myself as rational, so it is bothering me that this administration is making me wonder if the conspiracy theorists might have a point.     This is very similar to FDR's Federal Communications Act of 1934 which took control over the airwaves and which was used to control content (speech) that Roosevelt (and subsequent Democrats) didn't like. Zerobama wants to control the content of the internet--say goodbye to NealzNuze, FreeRepublic, National Review Online, Townhall and other conservative internet sites.

    Is this not what China already does? The United States government monitoring its own country's internet use is going past socialism into communism. If the government does this, I would love to see everyone stop using the internet and come up with another form of communication and information. Big brother is definitely watching.

    Invest some money and your account in a crypto firm established in a country not under US jurisdiction. You'll be fine for awhile. Otherwise, your internet access will consist of goverment patriotic songs.

    The Left has been wanting to bring criminal charges (including impeachment) against Bush for years because he was willing to loosen up restrictions on wiretapping in order to fight terror.

    Now they propose this? This makes Bush's wiretapping look like eavesdropping on the goldfish in your kid's bedroom.

    President Obama is wrong in one of two ways: Either A. He has done nothing but feed this mass hysteria, or B. He really is consolidating power to create a police state. I consider myself a logical thinker, butI am starting to wonder if it really is "hysteria" now.
