The court ruled that congress had the authority to change the rules on the currently illegal wiretapping to continue in its now legal form (because congress changed the laws).<br> <br> there's a big difference between ruling it constitutional and ruling that congress has the authority to change the rules that need to be followed.<br> <br> essentially, the court said that congress had the right to change the rules that Bush is now required to follow to keep the operation legal. It did nothing to address the formerly illegal operation performed prior to these new rules.<br> <br> they simply said congress has the authority to make these new rules.
