If I am not wrong, in Rasul v Bush the Supreme Court ruled that "aliens" detained in Guatanamo had the right to challenge their detention in American courts? I just can't see them being incarcerated in any Federal prison pending trail since they would probably get killed by their fellow prisoners. By Jake
